FLR (M) English language requirement

Hello,

My fiancee and I want to apply to switch to a spouse visa. I'm a British citizen and she is currently on a tier 4 student visa. She finished her master's course in the UK at the end of September, however still needs to await the assessment board's review in December before she graduates.

Section 31(a) at https://www.gov.uk/guidance/immigration ... d-evidence states an academic transcript can be submitted if the applicant is awaiting graduation; would a partial transcript covering her course/unit marks be sufficient, or will we need to wait for the assessment board review?

Section 31(b)(ii) says it needs to 'confirm.. the date that the certificate will be issued (if the applicant has not yet graduated)...', which the partial transcript doesn't, which is why I assume we'd need to wait until after the review or otherwise take the IELTS test.

(just to add - I've had conflicting advice from the UKVI contact number, with one person saying it should be fine if I explain it on the cover letter, and another saying she'd need to take the IELTS test, so I thought I'd ask here in case anyone had firsthand experience)

The call centre is outsourced to a third party agent, with poorly trained staff. You were not speaking to HO directly. The call centre also take no responsibility for information given out.

When does the tier 4 visa expire?

To use the transcript, it would have to be the full transcript, not a partial one.

Thanks for confirming - the T4 expires at the end of January, but we were looking to apply to switch next month. Am I correct in assuming she'd need to take the A1(?) IELTS test in that case, as she's not a citizen of a majority English-speaking country?

Yes A1 but no harm in doing same test at higher level such as B1 so that it become usable for future applications too.
