Post by Confused777 » Wed Nov 06, 2019 12:48 pm

Kindly need your help,

Hello. Iam due to make my husband join me in uk. Iam exempted from meeting the financial requirement but have to meet the adequate maintenance. I have everything that needs to be sent except i do not know how to do the calculations of the benefits i receive to prove if its enough to qualify. I have four children, two receiving dla. Here is what i receive

Carers weekly allowance: £66.15
Income support every two wks : £87.60
Childtax credit weekly: £294.62
Child benefit monthly: £247.20
Dla middle rate care monthly 1st child: £234.80
Dla high mobility monthly 1st child: £479.60
Dla middle rate monthly 2nd child:£247.20
Housing benefit monthly :£384.67(paid directly to landlord)
Council tax: £14

Is this sufficient?

Section 3 on Page 7 clearly explains it and there is a example table on page 8 and 9 too.

To an extent this will depend on your housing costs. Add up everything you receive as a weekly amount (A) and subtract your rent and council tax costs (B), this amount (A-B) must be greater than what an equivalent British couple would receive if they were on Income Support (C). I'm not all that knowledgeable about benefits, but based on a rough calculation it looks like you should meet the requirement depending on what your housing costs are.

Read the link posted by CR001 at least 3 times, it will clarify everything you are asking and also you don't a need solicitor to do your application as it's very straightforward.
My opinions should not be constituted as an immigration or legal advice.

As TODMATT said, you certainly don't need a solicitor as the application itself is fairly straightforward. You do, however, need to feel confident in the information you are supplying in support of the application and that you meet the requirements. Members on this forum can provide some opinions, advice and guidance but we can't do the application for you. If you don't feel confident doing it yourself, a professional can do it for you though not necessarily with better results than if you had done it yourself.

Thanks geogeng. Please list down the things you know i need to submit with my application
https://www.gov.uk/uk-family-visa/provide-information

The link contains a list of information the applicant will have to provide. With regards to meeting the financial requirement, you will have to provide the following:

"a) Official documentation from the Department for Work and Pensions or Veterans Agency
confirming the current entitlement and the amount currently received.
b) At least one personal bank statement in the 12 month period prior to the date of application
showing payment of the amount of the benefit or allowance to which the person is currently
entitled into their account"

The applicant will also have to provide evidence that suitable accommodation is available (sounds like you're renting so this will have to include a letter from you landlord indicating they do not object to your spouse joining you as well as evidence the accommodation will not be overcrowded). You will also have to provide evidence of your housing costs. The applicant will also have to provide evidence of meeting the English language requirement.

Thanks geogeng. What do you means by housing cost? Is it the rent? As its paid directly to landlord

Page 16 of the guidance document in the link provided by CR001 and TODMATT discusses housing costs and acceptable evidence. Page 11 of the guidance document has an example calculation including both housing costs and housing benefit. Just because your housing doesn't cost you anything doesn't mean there isn't a cost that has to be considered in the application.

Should be, a tenancy agreement if you have one would also be helpful evidence or a letter from the landlord detailing the rental cost.

I already gave an opinion on this. It depends on your housing costs (not yet provided) and I'm not entirely comfortable enough with calculating possible income support benefits for your situation to say with certainty one way or the other. It is a calculation you must be confident in doing yourself in support of your application and I'm not really sure where the continued confusion lies. If you aren't confident in preparing the application yourself with some guidance from this forum (guidance you have already been provided as the documentation from the Home Office sets out the requirements fairly clearly), you probably are better off getting assistance from a professional.
