Hi he did go back to his country to apply. And he did the english language test in the uk. I was worried that doing it in the UK when he didn't have status would alert the home office to his identity and location and ruin our plans of him voluntarily returning. But it was no problem. One solicitor told me he couldn't do it in the UK without a valid visa but rest assured you can.
Category A is based on having been with the same employer for more than 6 months. You can still use variable income under Category A. See Section 5.1 from page 20 of the guidance document linked below. Yes, you probably should have selected Category A or provided the 12 payslips necessary to meet the requirement under Category B (current salary and total income in past 12 months). I earn £28,000 a year as per my contracted basic salary but I do a lot of antisocial hours so each payslip I receive is a bit more then this depending on my shift patten. The payslips are very clear about this. So in fact I earn £34,000 when the 'times by 12' 'divide by 6' is applied.
I wrote I am category B as my income varies each month even though my basic salary of £28 000 is fixed. I have been in the job well over a year and included 7 payslips.
Should I have included 12 payslips / selected category A.
