FLR (M) application late (No fault of our own) - Need Advice

Post by matty007 » Sun Jan 26, 2020 12:23 am

Hi everyone,

I was wondering if someone could offer me advise, as I am a little concerned.

My partner's spouse visa is due to expire on February 22nd. We completed the application for extension and sent it in the post on Friday and specified that it should be delivered on Monday. However, the Royal Mail have made a mistake and attempted to deliver it today, which is obviously a weekend and the offices aren't open. Instead of holding onto it and attempting to redeliver on Monday, they have posted it back to us. That means that if we receive it back on Tuesday and send it on that same day, it will still be 3 days past the 28 days before expiry deadline.

I was wondering if anyone can advise me on whether this will pose issues to my partners application?. She has always applied on time, and had no issues. We sent everything early with good intentions, but Royal Mail have really let us down.

We have proof of postage, and tracking etc

Any advise would be appreciated.

Thank you

You're worrying needlessly. There is no '28 days' before expiry date deadline. You are able to apply no earlier than 28 days before and no later than the date the visa expires. In other words, you have until the 22nd February to submit the application.
(Casa, not CR001)
Please don't send me PMs asking for immigration advice on posts that are on the open forum. If I haven't responded there, it's because I don't have the answer. I'm a moderator, not a legal professional.

You should also be applying using the online form and not the paper form, which was withdrawn some time ago. Nothing is posted to ho anymore, everything is scanned and uploaded to the ukcvas portal before your booked biomteric appointment

You need to apply online which you can do until the last day of visa expiry. When you reapply online then make sure to attach the documents not older than 28 days from the date of application. You can use same documents if not older than 28 days.
