SET(M) 10 years route

Hello

I was granted an extension to my previous spouse visa SET(M) from in Oct 2017 for 2.5 years but I wasn't meeting the income threshold requirement but we had a child while my application was in process, so instead of refusing it HO granted me an extension on the basis of a baby involved and put me on the 10 year route instead of 5 years which normally is on a spouse visa route.

I'm going to apply for another extension now in May 2020 I'm confused which form I've to fill in the British child parent form or still SET(M)??

Set m is for those who spent 5 years on spouse visa and now are applying ILR which won't the case in your situation. Maybe following form is the appropriate:

Sorry August 2013 was the time when I was granted first leave on spouse basis for 3 years and then I applied further extension in August 2016 which took over a year for my application to process and ended up in being granted further leave as I explained above.

Set(M) is the form for ILR when you have held a spouse FLR(M) visa for 5 years. SET(M) is NOT a visa extension form.

Your new ILR clock started from October 2017 and if you will continue to extend it then may qualify for ILR in October 2027. Alternatively you may be eligible for ILR based on 10 years of legal residence (Set LR) where all visas are counted. You haven't mentioned as when had you legally entered into UK because based on that date and your legal stay you might even be eligible for ILR far earlier than on your present route of flrfp.

I legally entered into the UK in Dec 2013 on the basis of spouse visa but this was granted while I was residing in Republic of Ireland and due to that there's no entry stamp on my passport because I travelled within the EU. But yes visa granted in August 2013 and I entered in Dec 2013. Thanks

Wasn't you be asked about activating your spouse visa? You must have given your date of arrival in previous application forms and have e-tickets which you may use to support your SET(LR) application in Dec 2023 if you will continue to live legally.

Yes I wasn't married yet but had spouse civil partner visa and yes applied as unmarried partner.

What are the chances if I contest my case through proper consultation, of getting ILR on on the bases of spouse visa which I should have in 2018 because my 5 years completed by then. Though they put me on 10 years route already of FLR(private life in UK). They just confused my case from the beginning and to be honestly I never bothered at the same but just a thought??

You should have contested on that time if you were 100% sure of being able to meet the essential requirement. At the moment the only shortest route would be to wait until 2023 for set lr.
