FLR (m) when to apply? and cohabitation evidence

Post by assadmah » Sun May 17, 2020 7:23 pm

Hi,
My wife came on a settlement spouse visa from Pakistan to the UK in 2018 and will soon need to apply for further leave to remain flr (m).

1. I would like advise on when exactly to apply for the next stage in her application. I am aware there is a 28 day rule before applying.

UK visa entry clearance sticker in passport: Valid from: 11/05/18 and alid until: 10/06/18
Letter that came with visa: You will have permission to be in the Uk (known as leave to enter) as PARTNER (STANDARD) FROM 11 May 2018 to 11 Feb 2021
BRP card: Place and date of issue: 28/04/2018 and Valid until: 11/02/2021

If I follow the visa vignette then 2.5 years from 11th May 2018- that makes it approx November 2020 (30 months)
If I follow the immigration letter: 11th May 2018- 11th Feb 2021= 33 months (this is more than 2.5 years)?

2. Evidence of cohabitation: Is there a rule on which type of evidence you have to submit. For example are NHS prescriptions fine? (the attached white section which also has name and address), election material from political parties or polling cards and ordering items online.

Thank you.

1. What date did your spouse ENTER the UK?? All residnece is based on date if entry and not the visa issue date.

2. You need 3 to 6 sources spread evenly for every 3 or 4 months of cohabitation evidence. Anything in both names, letters, council tax, utility bills, TV licence, HMRC letters etc etc.
Char (CR001 not Casa)

Thanks for the prompt reply
1. She entered the UK on 19th May 2018.

2. I guess that means anything is fine as long as the evidence is sensible and has date, name and address.
Checking my evidence from last year, I do have a 5 month gap from 23rd May 2019- October 2019. If it has to be every 4 months then I am approx 1-2 months out. Would this raise any issues?

I think nobody can give any certain reply as whether will it affect or not because the word "even" has no exact definition except assumptive belief that it should remain within the range of 3-4 months. If you try to find then may find something in individual name.

Thank you for the reply seagul. I understand it is all an assumption but best to follow the guide of 3-4 months.

I just have one last q based on the post I created. Will appreciate if you can answer.
I am unsure about when to apply for flr (m).
If my wife entered the UK on 19th May 2018 does that mean I apply 2.5 years later (30 months) in November 2020 this year or do I go with the expiry on the brp and visa letter which state February 2021 (33 months).
I am aware whichever month I pick there is the 28 day rule I have to follow.

You can apply extension anytime from 22 October 2020 till expiry.

If your personal circumstance or immigration policies including fee isn't going to change then applying very close to expiry is good option to avail the maximum length of visa.
