Confused about UK spouse visa application

Post by okhajut » Mon Jan 20, 2020 12:08 am

I recently got married. My wife is in Pakistan. I am a citizen of UK having lived here for many years.

I have found that I need to apply for "Spouse visa" to bring my wife to UK to live with me.

There are a few things that I am confused about, maybe someone here can help me:

1. Can I make an application for the spouse visa here in UK and my wife can send me all her documents by post? As for the finger prints, she should be able to give them there in Islamabad city. Or,
2. The application can only be submitted in Pakistan by her, and I shall have to send documents to her e.g my evidence of employment, bank statements, evidence of accomodation e.t.c.
3. Will the application form be filled in on paper and posted with all documents, or it will all be done online?

Since the application requires some details from my side, and some from her side, it is not clear if the application can only be submitted in Pakistan or also in UK. I have only ever made applications as a single person.

4. How many screenshots of message exchange e.g whatsapp or facebook messanger are required?

As for employment, since I need letter from my employer and probably need to show salary coming into my account, what will happen if:
5. I am made redundant just after the application is submitted
6. Made redundant just before the application is submitted?
7. Decide to change job after the application is submitted?

Also,
8. Are details of her employment i.e letter from employer, her payslips e.t.c. required from Pakistan?

A mortgage applicaton is in process but will take several more weeks to be completed. The spouse visa also requires evidence of accomodation.
9. Can the visa application be made stating that the mortgage application is in process (with required evidence from the involved parties in this transaction) and will be completed while the application is being processed or before my wife has to come to UK? It would be strange to get a place on rent for 6 months or less, just to be able to make a visa application.

1.Yes you can make the application here in the UK. It will be better if you submit the documents here by going into one of the VFS global walk-in centres and paying a £75 fee

2. You can do the application on her behalf

3. Filled out online and you can review what you have done before submitting.

4. As much as possible

5. There's a chance it could be refused
6. There's a chance it could be refused
7. Ideally, stay in the job until the application is decided. Otherwise, you will have to wait another 6 months.

8. No, they will only take your income into consideration
9. Ideally wait until the mortgage transaction is completed, submit a copy of your Land Registry title deeds showing proof of ownership of the property. You will also need to get a property inspection report.

I am not a qualified lawyer so this not should be taken as legal advice. What I will say is ideally you should get some legal advice before you proceed

Application is made online in U.K. and biometrics are done at Islamabad. TB test done in Islamabad and don’t forget the English test A1

2. The application can only be submitted in Pakistan by her, and I shall have to send documents to her e.g my evidence of employment, bank statements, evidence of accomodation e.t.c.
see answer to Q1. Apply from U.K. document will be scanned/uploaded from U.K.

3. Will the application form be filled in on paper and posted with all documents, or it will all be done online?
application is done online. VAFA4 is printed out, filled in and then scanned. Supporting documents may need to be scanned if they are hard copies I.e. Nikkah papers, passports

Since the application requires some details from my side, and some from her side, it is not clear if the application can only be submitted in Pakistan or also in UK. I have only ever made applications as a single person.

4. How many screenshots of message exchange e.g whatsapp or facebook messanger are required?
export the WhatsApp/message history along with screenshots. I did 4 screenshots per month and combined into an A4 word document. All documents need to be in A4
As for employment, since I need letter from my employer and probably need to show salary coming into my account, what will happen if:
5. I am made redundant just after the application is submitted
May get refused when Home office contact employer
6. Made redundant just before the application is submitted?
if you are applying via category A which is that your application is dependent on your salary then will get refused. You have options to apply with other category i.e cash savings of £65k or higher
7. Decide to change job after the application is submitted?
don’t do this as the application may get rejected if they contact employer
Also,
8. Are details of her employment i.e letter from employer, her payslips e.t.c. required from Pakistan?

A mortgage applicaton is in process but will take several more weeks to be completed. The spouse visa also requires evidence of accomodation.

wait until mortgage is completed. Provide land registry, mortgage statement and house inspection report

Spouse visa application requesting NARIC report AND English language test certificate

Post by okhajut » Thu Jun 18, 2020 8:03 pm

I have not found a solution for this yet. There is a question on this forum but no conclusive answer and thus I am asking again. This is related to spouse application for my wife that lives outside UK.

The form asks questions related to English language from the applicant, these are copied below with the answers given in the application form

Do you have a degree that was taught in English? [Yes]
Country your degree was taught in [Pakistan]
Does your degree meet the English language requirement for this visa? [No]
Have you passed an approved English language test? [Yes]
Did the test assess your speaking and listening skills at a level equivalent to CEFR A1 or higher? [Yes]
How did you get your result? [Certificate]
We may have to talk to you about your application. Which language would you prefer to use? [English]

It has been discovered that if the first question is answered yes, the document checklist at the end of the application has 2 check boxes, one for NARIC report of degree and the other being the English level test certificate. This appears strange since answering No for the third question should not result in this outcome. We are not relying on the degree to show compliance with the English language requirement anyway. Basically, as long as the first question is answered yes, we cannot complete the application process without checking the box for the NARIC report. Answering No for the first question is not truthful since my wife does have a degree taught in English from Pakistan. She is a dentist by the way.

It is not clear how these questions should be answered such that the NARIC report checkbox does not show up at the end of the application process. The checklist at end has these 2 boxes:

[ ] NARIC letter that confirms the qualification meets or exceeds the recognised standard of a Bachelor's or Masters degree or PhD in the UK AND confirm the level of English to which the degree was taught or researched
[ ] The language test certificate for LYBA ASHRAF to prove the level of English language required

Unless we check both, the error says "tick all the boxes to agree that you will provide these documents". Because of this, the application cannot be submitted. What do I do? Somebody told me to check both boxes and explain the problem with the form in supporting letter but that seems risky.

If you are using the English test, the tick NO to the degree. The degree question is ONLy relevant to meeting the English Requirements. Ho don't care about her qualifications otherwise.

ok, but why ask "Does your degree meet the English language requirement for this visa?"
When I said no and then it asks for NARIC report, I am like what nonsense is this !!???

Say NO to all degree related questions. If you say yes you will be expected to prove the naric English and comparable assessment.

Ok thanks. The chat and calls logs exist on the sponsor and also the applicant's mobile phones. Now the question is, does only the applicant provide the call and chat logs (from whatsapp and facebook e.t.c) or both the applicant and sponsor? The bigger question is, how does Home office know if these call logs are between the applicant and sponsor and not between applicant/sponsor and some third person.

Call/chat logs can be provided from either side instead both and to justify that these are exchanged between both of you then you can create & attach snapshot of profile detail. Also these alone aren't sufficient to prove subsisting relationship evidences because other evidences are also expected such as entry & exit stamps, pictures, emails, money/gift sending receipts etc.
The opinion expressed as above is neither a professional advice nor contesting/competing to other member's opinion/advice.
