Spouse visa 5 year route. Entry to clearance stage had a viginette which was issued in her passport. But the last passport had since expired and we had made a new one which was then used for FLRm.
HO was asking for the initial 30 day visa vignette, now in an expired passport, which will have the stamp of date of entry to the UK (this is what determines eligibility for ILR). They were not asking for the FLR(M) BRP received at extension stage.

Presumably it was not an initial 6 month fiance visa that was granted??
No it wasn’t a fiancé visa. It was a spousal visa under the 5 year route. Not sure where to go from here though I’ll see what they reply with. When we had the new passport made they took the old one from my memory.

Can you point me to the rules which states this or is it in the form? I must have missed this, but we are very lucky to have kept copies.

The date of entry on a spouse visa is what determines when an applicant is eligible to apply for ILR, i.e. 60 months spouse visa minus 28th days. Normally all previous passports need to be scanned and uploaded, included all stamped/visa pages.

This will likely all be required again for citizenship.

Wasn’t aware of previous passports, so we are in a bit of a pickle there but luckily the stamps of entry and leave to the country are on the scanned photocopy of the vignette too.

I find it strange that even after flr m stage they require this as would it not all be on the system anyway?

It is not HO's job to scurry around looking for stuff that an applicant didn't submit or what might be relevant from a previous application. It is and always has been/will be, the applicants responsibility to submit everything required for each and every application they make, regardless of if 'it is on the system' already.

Thanks for that. I was under the impression they cross referenced every stage of the application with the one previous. I was obviously wrong in my thought process there.

I’ll keep everyone updated with how this goes, hopefully it should be ok now. I went over everything so many times, making sure we had all the documents relative to our application.

Really appreciate your help and advice. Thank you so much once again.

They do but they cross reference what you state in application forms and evidence that might have been submitted to find out if anything has changed or someone is lying or using deception or misrepresentation. They don't go look for stuff that wasn't submitted and might be relevant to the current application.

I see. Well I appreciate your time to explain this to me. It’s a lesson learnt regardless. I just thought the brp would be enough but it makes sense as to why they would need to see the vignette also.
