FLR (FP), 10 years partner route confused!

Post by fib425 » Fri May 15, 2020 12:54 pm

Hi Amber Hope you are well

I have read your replies regarding UC and FLR fp 10 year route before (i could not find the same string again)

I am on a 10 year route (applied for a 3rd extension) my wife and 6 year old son are british

you stated before the contract of house/residence should be on the name of the person/partner who is british if we want to apply for UC.

but for FLR FP(10 year) we have to show the home office that we are living together and both names should be on the Contract moreover for the council tax support we have to show both names on the Contract of House.

So should i ask my Landlord to remove my name from the contract of the house to apply for UC.

Thanks

Whist not being fully familiar as what might be the resultant impact if the tenancy agreement only have the claimant name. But under right of rent policy it may not be legally plausible because every prospective occupier gets checked & referenced and therefore have to be named on the tenancy agreement. Most often no private landlord offer such courtesy due to avoiding any indecipherable eviction process in future because S21 can become invalid.
What should be in a tenancy agreement
A tenancy agreement should include:

the names of all people involved
the rental price and how it’s paid
information on how and when the rent will be reviewed
the deposit amount and how it will be protected
details of when the deposit can be fully or partly withheld (for example to repair damage you’ve caused)
the property address
the start and end date of the tenancy
any tenant or landlord obligations
an outline of bills you’re responsible for
https://www.gov.uk/private-renting-tena ... -agreement
The opinion expressed as above is neither a professional advice nor contesting/competing to other member's opinion/advice.

Thanks Seagul

Very well explained

but relying on "may not be legally plausible" and "Most Often" is a worrying Thing.

FLR(FP) and UC claim

Post by fib425 » Tue Jul 28, 2020 3:29 pm

Hi everyone

Hope everyone is well
Can i ask after all this discussion i cannot get to a point it's still grey, i am looking for a Black or White

https://www.gov.uk/government/publicati ... ces-change

the question is
does the eligibility section in the link above means if i am already on a 10 year route through FLR (FP)
will it effect my extension if my Mrs Claims UC as she and my Son both are British?

For the sake of Information i already have application in Process but the Sopra office Closed in March after i submitted application FLR FP on 23rd of March online .... i got two dates which got extended through out COVid and submitted docs in 11th of June 2020.

Thanks for Everything

You are on the 10 year route, as you have stated yourself in May 2020 (topics merged).

Unclear what exactly your question is regarding the link.

Your wife can claim UC, but you have to claim as a couple, where the total household income is taken into account. She cannot claim as a single parent.
