ILR dependent visa advise?

ILR dependent visa advise?

Hi,

I currently have Tier 4 student visa and I have applied for ILR (LR 10-years) and awaiting decision. My wife is a Tier 4 PBS dependent living with me and her visa is expiring in one month.

Can I please have advise under what category should she apply?

As a student you most probably wont be earning £18600 so applying flrfp visa might be appropriate but if your ILR will fail then flrfp application would be failed too.

I have been recently employed after finishing my Tier 4 course and have been earning in excess of £18600/year. Does that makes any difference in terms of applying category?

When exactly did you start working?

For your dependents FLR M visa, you need a minimum of 6 months evidence of earnings, payslips and bank statements, proving you earn a minimum of £1550 before tax for each month to meet the financial requirement.

Does your spouse work?

My spouse doesn't work and I started working for my current employer like a month ago and I do not have 6 months payslips unfortunately.

Then your only option as you don't meet the financial requirement, is to apply on the FLR(FP) 10 year Partner route. Presumably you don't have any substantial savings either??

Yes I do not have too much savings. So the only option is to apply through FLR(FP), but then of course the decision will be based on the outcome of my ILR application.
So shall my spouse apply for FLR(FP) and then add a cover letter explaining that partner ILR is awaiting decision?
Because at present, the ILR decision can take more than 6 months.
