5 year partner route - extension

Dear Members,

**This question is on behalf of my friend**

He was granted Limited Leave to Remain for 30 months under paragraph D-LTRP 1.1 of Appendix FM to the Immigration Rules on 14 March 2018. His visa is expiring on 27 September 2020.

He switched to partner route inside UK. The duration on the BRP is 30 months and 13 days in total.

1) If my understanding is correct, he can apply 28 days before reaching 30 months residence (as he was already inside UK so from issue date on BRP?) OR up to 28 days before visa expiry? Usually the initial LTR is for 30 months. Why does he have 30 months and 13 days?

2) If my understanding is correct, he needs to apply for an extension on FLR(M) online?

3) He needs to prove income requirements, UK degree, cohabitation documents for the last 2 years plus IHS?

Please can you confirm the above.

1. Yes he can apply 28 days before completing his 30 months or until the last day of visa expiry. Usually the visa issued from UK is valid for 30 months in comparison with outside of UK where it is valid for 33 months. Extra 13 days in your friend's case is bit unusual.

2. Yes

3. Yes the income requirement is same as previously of £18600 (excluding any dependant). If he has UK earned at least bachelor degree then would be exempted from English test otherwise will need A2 ielts or naric red route report. And yes 6 piece of cohabitation evidences from at least 3 different sources covering the last 2 years will need.

Visa issue: 14/3/2018
Expiry: 27/9/2020
Comes to 30 months 13 days (if my calculation is correct)

I myself am unsure about the duration. Indeed a bit unusual.

3) He has a UK Masters Degree so he will be exempt.

Also, regarding the income requirements he needs minimum 6 months payslips and corresponding bank statements? Is there any requirement for the date on the last salary slip before applying like not more than 28 days old?

Does he also need an employer letter?

he will use his own income to fulfil the income requirement. Does he need any more documents in that case as his spouse (sponsor) is a house wife OR only 6 months salary slips, corresponding bank statements and employer letter?

Yes, £1000. It is increasing in October from £400 per year to £625 per year.

Nothing will be needed from house wife provided the main earner is earning sufficiently. Latest (6th month) payslip, bank statement and employer letter must be dated within 28 days. Also try to remained employed with the same employer until the decision arrives.
