Hi Team

I have got Indefinite Leave to Remain this month (August 2020) using Tier 2 ICT category ( 5 years, as my initial entry to UK was on August 2007)

My spouse along with my son joined with me on September 2015 under Tier 2 ICT Dependent.

Can you pls advise under which category and when, my dependents (spouse and my son) can apply for Indefinite Leave to Remain.

If you got your ilr based in 5 years Set O form route, then your dependents also apply for ilr on form Set O form.

They can apply within 28 days before the 5th anniversary of their initial visa issue date.

Thank you CR001 for your response.

In SET (O), it has been mentioned for dependents as " You must also have been living with your partner in the UK for at least 5 years if you applied for your current visa on or after 9 July 2012"

Whether my spouse and son can still apply 28 days before their 5 years of living with me in UK, even though it was not explicitly mentioned in SET (O) form about applying "28 days before"?

To be clear on the date on my spouse and son's visa and UK arrival date:

visa issue date: 21st Sep 2015
came to UK: 25th Sep 2015

On a separate note, thanks a lot CR001 for your guidance, support and advise on my case and have received ILR decision email last friday.

They can apply for ilr no sooner than within 28 days before 21 September 2020.

Hi Team

One more clarification pls.. I am applying for my dependents now for ILR... Though i have detailed out above on the case, just to be brief:

"I have received ILR on Aug 2020 based on SET(O) 5 year route on Tier 2 ICT (initial visa Aug 2007)"

My spouse and my son are eligible by Sep 2020.

Clarification required pls on the below:

When applying using SET (O), my spouse has stated the route for ILR as "Tier 2 Dependent"..
Later in the application form, it has asked about the sponsor and the relationship with the sponsor. My wife stated me as the Partner and in the application form, it has asked about my details. In that, one of the question is:

"Which visa is "my name" (sponsor) applying for on been granted?" ."Choose the route that my name (sponsor) has applied for or been granted, even if their application is still being processed"

In the dropdown, it is not stating as "Indefinite Leave to Remain" rather it has all the Tier 2 options.

Last week, I have been granted Indefinite Leave to Remain approval email and BRP card yet to be received next week.

Can you pls advise why in the drop down on my case, it is not showing Indefinite Leave to Remain, rather it is showing all Tier 2 routes?

Also pls advise what should i do now on my dependents case?

Select Tier 2. You will then be asked for your last CoS and sponsor details which you need to also provide.

I have selected Tier 2 - Intra Company Transfer(Long term staff),as i have got the ILR based on that route ( 5 years - Set (O)). Hope it is correct?

It should be asking for your previous sponsor and CoS details on Set(O) for your dependent.

Hi CR001, (Apologise for a lengthy details)

I am filling out SET(O) application.

Pls note: I have applied using SET(O) earlier and got my ILR- BRP card by 10th of August 2020. Also, my route to ILR was Tier 2 ICT - 5 years since my first date of entry is August 2007.

Now my spouse and my son are completing 5 years by next week.

Is the SET(O) application correct pls as i am applying ILR for them now?

Also, while starting the application, as the first question, it has asked " what is your situation", my spouse has selected "YOU'RE THE FAMILY MEMBER OR PARTNER OF SOMEONE WHO HAS SETTLED IN THE UK".

Second Question: "How did they settle?", my spouse selected as "ON A WORK VISA".

Third Question: "what type of work visa did they settle with?", my spouse selected as "A Tier 1, Tier2 or tier 5 visa"

After this, it got redirected to the page "SET (O) -Settlement - other"

Then after logging into the application:
first question: " In which category are you applying for ILR"
My spouse selected as "Tier 2 Dependent" (pls note - there is no option to select as Tier 2 ICT)

second question " are you the partner or child of your sponsor"
my spouse selected as "partner"

Third question: "person you are applying to remain in the UK with", my spouse replied with my details, along with my passport, new BRP card details (ILR) and NI number.

Fourth question: "which visa "my name" applying for or been granted"? My spouse replied as "Tier 2 (ICT)Long Term staff". (pls note - it does not have the option as ILR)

fifth question: Then it has asked for VAF or GWF number

These are normal. You select your last category before ILR. The list never has ILR as an option.

If you don't have the reference numbers, simply tick the box that says 'I don't have'.

I have the VAF number as part of my first entry to UK visa (Tier 2 -ICT - Aug 2007) and don't have any other VAF number of mine. Also I am not sure about GWF number.

my spouse tried clicking "Dont have any reference numbers", after that it moves to the next page about the applicant details (about my spouse details)

It did not asked about previous CoS or sponsor details.

Can you pls advise me what i should do now? whether i am making any mistakes pls?

Thank you CR001.. .I have continued further with the spouse application and my son.

My spouse has completed the form. It did not asked for "my" previous CoS details and sponsor details.

In the VAF number, my spouse has given the VAF number which is available in "my" first entry to UK visa (Tier2 ICT - August 2007)

Hope i have not done any mistakes, as i am little bit concerned since the form did not asked for any CoS details :(. Hope there is no issue in it.

Hi Team

I have got my ILR thru SET(O) by Aug 2020. Now processing ILR for my spouse and child.

Have looked into the other posts with regards to documentation for dependents. With regards to cohabitation documents for the last 2 years, unfortunately me and my wife has joint account only for Council Tax and the rest all the utilities and housing agreements are in my name.

Hence my wife has Bank account independently on her name and her name will appear in Council tax jointly with me.

Can you pls tell, in this case what are the documents we can provide pls? whether we can provide the documents in independent names with the same housing address?

Whether we can show the letter which we occasionally receive from NHS?

Also whether it is ok to receive the letter from my son's school stating both the parent's name and stating that he is studying for last 5 years? whether it will serve the purpose of one of my documents having me and my wife's name?

With regards to my son (8 years old - born in India), what are the documents I should show it pls?

Your suggestions and advise will be of great help for me.

Any letter/correspondence having name & address on it from credible sources (excluding personal/informal statements) can serve the purpose.

But there are only limited documents in both of us names that too not spread across evenly across 3 or 4 months for 2 years other than Council Tax....

Pls advise what should i do now?

Also, whether independently - myself and my wife can show the bank statements pls? Also for 2 years means, it is running to 50+ pages on my case, whether i can show my savings account (it will not have any day today transactions) rather than my current account?

Also, what set of documents should i need to provide for my son pls?

Few documents almost everybody receive customarily such as broadband bill/mobile bill, nhs/dvla/hmrc letters, car/home insurance, marketing stuff from service provider/bank etc.

Only the date of the issuance/printing/downloading of statements is mattered instead transactions.

Strictly refer to checklist but obviously 2 years of cohabitation evidences won't be needed from child.

Yes individual named letters can be used but from at least 3 sources.
