Calculation for applying ILR

Hi All,

I want to confirm applying for ILR according to the document available on gov.uk site which says:

Calculating the specified continuous period
Applicants can submit a settlement application up to 28 days before they would reach the end of the specified period.
You must calculate the relevant qualifying period by counting backward from whichever of the following is most beneficial to the applicant:
• the date of application
• the date of decision
• any date up to 28 days after the date of application

According to them I can apply 28days before the date I made my Visa application 5years ago?
So, if I made Tier 2 (General) application on 27th Aug 2015 and according to the gov website document (the paragraph I mentioned earlier) I can submit my ILR application on 31st July 2020?

No, you can apply no sooner than within 28 days of the 5th anniversary of the initial visa issue date.

The piece you quite refers to the date of ILR application, NOT date of application in your home country initially. It does say clearly "counting backwards from", ie ilr application date.

Thanks for your reply, as per your advice my understanding is:
If my visa issue date on BRP is 11-09-2015 then I can apply on 15-08-2020 or 14-08-2020?

I am a little confused :? to include visa issuing date or not in the calculation of 28 days.

Please suggest.

Why do you want to apply on the DOT? Its always best to give 1-2 days margin to avoid any calculation errors. Its 14th Aug to be exact. But I would still apply on the 16th if I was you.
