Naturalisation after ILR

Post by miche868 » Wed Aug 19, 2020 9:25 pm

Apologies if this has been asked and answered already. I have read many posts but nothing on my specific scenario.

I recently got ILR for myself and my dependant child who was NOT born in the U.K.
My husband is British (Born in the U.K.).
If I apply for naturalisation do I need to do the same for my dependent at the same time?
Can I apply for citizenship for myself first and then apply for citizenship for my dependent later on?
My husband is not the dependant’s legal Or biological parent.

Thanks in advance for your help.

Yes. The child will only qualify for citizenship once you are British anyway.

Where is the child's biological father?

The child’s biological father lives in a different country and has no parental responsibility/legal guardian rights.

Just for my clarification, if I apply for citizenship and that gets approved and I become a British citizen, then at that time, how does that affect the conditions under which my child is in the U.K. (as the child would have been my dependent on ILR That I would not have anymore as my status would have changed)?

Very sorry for the long winded question :-)

The child silt is dependent on your British spouse, not you.

You weren't the sponsor for the visa and ilr, your spouse was.

If you become British, ilr for the child doesn't just become invalid.

Ilr is an independent status, there is no immigration dependency on anyone for those holding ilr.

Fantastic, many thanks for the clarification.
Sometimes I forget as I usually use my earnings and not my husband’s to meet the financial requirements but you are right, In the end he is the sponsor and that’s what matters!
Thanks again!

Note also that she can only register as british without 12 months on ilr if she is under 18. If she is 18 or older, she has to wait.

Yes the child is under 18 so I guess this is fine. We may wait anyway as there is no rush to sort out naturalisation for the child.

I will just get it done for myself as I have more free time as i’m off work for the holidays. So I can properly concentrate on the application process before I get busy again.

Thanks again for your help!
