Eligibility of Parents to get long term visa and ILR

Post by Thambidurai » Thu Sep 03, 2020 12:48 pm

Hi,
I have a few questions on the eligibility around getting long term visa and a path to ILR (If possible at all) for my mother in law.
I have applied for ILR through 10 year route and awaiting confirmation for submitting biometrics or using IDV app. Got married and my wife is staying with me in UK since June 2013. I was told that upon me getting ILR, my wife would need to go for FLR (M) and will be eligible for ILR only after 5 years as clock resets to zero.
I have mother in law back in India, she irs on her own as my father in law is no more and my wife is the lone child for her. She had travelled to UK a couple of times with visit visa and has followed theme rules. Am trying to understand possible options to have her reside with us in UK, it would be great if some advise is provided on

a) How to go about getting long term visa for her (a 5 year visa ?)
b) If there is a way a case can be built up for her ILR in the future

Thanks.

Her visit visa was given on the condition that she will return back instead try to settle in UK. Therefore, any intention of settling in UK by spending more time here than in native country might lead towards the cancellation of even her present visa as well.

Hi, thanks for the response.
Sure she is not looking at spending any additional time beyond what her visit visa allows. I was more wondering if there are any options for my mother in law to stay or settle with us in UK as my wife is the lone child for her and my father in law has also expired, so there is no support system in place for her back home. If there are no options, then we will have to plan around that but thought to check.

Short answer there is no possibility and as mentioned earlier don't even try to venture out any new experiment.

I suggest you read the link below to understand the extremely difficult visa route. If you choose to apply and take the risk, it will be refused and it will shut the door on any future visitors visas too.

So in short, there is no route to settle in the UK based on what you have posted.

Thank you very much. Just one final query,
Am at the moment applying only 6 month visit visas for her, will it be fine to apply for 5 year visit visa. I completely understand she can't stay more than 6 months at one go but at least it will avoid the hassle of asking her to visit VFS more often for visit visa, particularly with her not having much support back home.

Better don't apply for 5 years now rather apply for only 6 months or 2 years.
