It was refused initially bit granted on appeal using same English test certificate at level B1. If this was the case then it is reusable for the extension. When was the Appeal granted and initial entry of the spouse into UK?mrblah wrote: ↑Thu Jul 16, 2020 11:11 pmHello all,
I applied for my wife in the year of 2016. The application was refused, however, this was then appealed.
Before the appeal taking place, HO withdrew the original decision and issued a visa.
My wife obtained B1, she took IELTS test in Pakistan at British Council (High Commission).
My take is that test certificate can be relied upon as it was accepted previously. I note the refusal but the decision was withdrawn. I had no issues in respect of english language.
I note generally guidance says if the application was refused, you cannot rely on the certificate.
Any comments?
If the appeal was allowed at later then it emblem as if refusal was never happened.mrblah wrote: ↑Thu Jul 16, 2020 11:11 pmHello all,

Thank you for the response. She came to the UK in 2018, April.AmazonianX wrote: ↑Fri Jul 17, 2020 5:30 amIt was refused initially bit granted on appeal using same English test certificate at level B1. If it is the B2 that was used in getting the initial entry visa then she is more than sorted. Cheers.mrblah wrote: ↑Fri Jul 17, 2020 4:58 pmThank you for the response. I must also add that she obtained B2, not B1, which is higher in any event.
HO withdrew their original refusal in December 2017 and then as usual, were late and lazy issuing the visa.
mrblah wrote: ↑Sun Sep 06, 2020 12:50 amGood Evening All,
I'm a self-employed contractor and my wife's visa is due for renewal. I can show my income by way of Tax Returns and accounts but I rather rely on savings, it is perhaps more easier. I also have a tax bill which I need to pay by January 2021 for the previous year. As I have not paid that, I do not want HO knit picking things for the sake of it.
I have two savings account which have the following balance:
(1) £50,000.
(2) £20,000.
On or around 5th May 2020, a payment of £2,650 was "bounced" from my first account into my current. This was because I had gone over the "ISA limit" for the previous tax year. I immediately put the money back in, from my current account into my ISA. This can be shown and seen easily.
I am saying, even if that's taken into account, and worst case scenario my savings in ISA never fall below £45,000 + £20,000 - I am still meeting the threshold. Yes, as with the amounts stated your savings never went below the savings threshold. Do note the need to write a letter of declaration for the source of the savings.
Is my understanding correct? I just do not really trust home office individuals and they have their own way of calculating things.
Also, I have completed the online form. I have also mentioned in there with regards to finances. Is my understanding correct that for extension, I do not need to complete a form using a pen. Basically, it is pretty much online. Yes, all you need to fill is the online form, no paper to print off and fill with pen.
Lastly, my Mrs visa is expiring in December 2020 (20th precisely), I am thinking of applying on 30th September 2020, yes I do not fancy paying extra for NHS Surcharge. My understanding is, if and when the new visa is issued, it would be from the date it is granted, so if they take 2 months to process the same (say the approve the application on 2nd November), my Mrs will be able to meet the continuous 5 year resident route for ILR. I do not want to apply too early to have issues with ILR! but I don't think I am applying too early.
Thanks for your help/comments.
That's correct.mrblah wrote: ↑Sun Sep 06, 2020 12:50 amLastly, my Mrs visa is expiring in December 2020 (20th precisely), I am thinking of applying on 30th September 2020, yes I do not fancy paying extra for NHS Surcharge. She entered UK on the 18th April 2018. The application was made outside of the UK.Korekt wrote: ↑Sun Sep 06, 2020 8:43 amThat's correct.mrblah wrote: ↑Sun Sep 06, 2020 12:50 amLastly, my Mrs visa is expiring in December 2020 (20th precisely), I am thinking of applying on 30th September 2020, yes I do not fancy paying extra for NHS Surcharge. When did they first enter the UK on this visa?
Or if the application was from the UK, what date was it issued?
She can apply after 29 months & 2/3 days counting from the date of arriving to UK till the last day of her expiry. There is no template rather you can use any easier wording. You can read about cash savings in depth at below link:
Thank you for the response. So, as she entered on 18th April - this year in April would be 24 months.seagul wrote: ↑Sun Sep 06, 2020 11:30 amShe can apply after 29 months & 2/3 days counting from the date of arriving to UK till the last day of her expiry.
