It will not be from the expiration of the previous visa but from when the decision is made by case worker, howeve you have continuous leave as you have applied before the expiration of the previous spouse visa, therefore what you focus on is the counting of 60months - 28days from initial entry into UK of your spouse.as3m wrote: ↑Sun Sep 06, 2020 9:24 amHi,
Visa expired 1/7/20 .. application for extension FLR(M) was made 7/6/20. Due to limited capacity, we only just enrolled biometrics yesterday 5/9/20. My question is, from which date will the 30 month extension (if granted) be valid from? It would surely make sense that it is from 1/7/20?
I’m just asking as it would make our eligibility for ILR sooner
The time during which the application was remained in process will be deemed as if you were holding the same visa by virtue of section 3C.as3m wrote: ↑Sun Sep 06, 2020 9:24 amHi,

Ok, my wife entered the UK in mid Oct 2017. Therefore, if I understood correctly, regardless of when her extension expires - she is eligible to apply for ILR in Oct 2022? And not have to wait the full 30 months from when her extension is grantedseagul wrote: ↑Sun Sep 06, 2020 11:32 amThe time during which the application was remained in process will be deemed as if you were holding the same visa by virtue of section 3C.as3m wrote: ↑Sun Sep 06, 2020 9:24 amHi,

Yes correct and most probably her visa might expire well after her date of eligibility for ILR.as3m wrote: ↑Sun Sep 06, 2020 12:15 pmOk, my wife entered the UK in mid Oct 2017.
