Tier 2 General to ILR application

Hi Gurus, Moderators and senior members helping us all the time

I have a question and getting bit worried :
Back in 2015, when I first applied my T2G

PLEASE SELECT UNDER WHICH CATEGORY OF THE ENGLISH LANGUAGE REQUIREMENT YOU ARE CLAIMING POINTS FOR
I answered: DEGREE TAUGHT IN ENGLISH
because at that time we didn't require NARIC as my university was included in the list.

However, for ILR application, I got Trinity CEFR B1 certificate, hence I have to answer like this:
Do you have a degree that was taught in English? No
Have you passed an approved English language test? Yes
Did the test assess your speaking and listening skills at a level equivalent to CEFR B1 or higher? Yes

Will this cause any discrepancy ? What can I do to avoid any issue ?

If you had selected 'Yes' to "Do you have a degree that was taught in English?".Would it not show you the option of fulfilling English requirement via Trinity certificate?Is it not possible in the ILR form that you studied degree in English but do not claim the points via degree.

I ask because I can see I would have the exact same ques when I fill the form.

For ILR application you ONLY have to tick one option. Lets say your degree was taught in English but you do not have the NARIC certificate or its not valid, just select NO to English degree as you can not claim points for it.

The form will then ask about how you fulfil the English Requirement now. You will have to input your B1 English SELT details and tick B1 certificate.

I dont have NARIC certificates as I couldn’t get Transcripts & Medium of Instruction letter due to covid lockdown. So I got Trinity certificate.
If I select “Yes” to English degree then it will ask for NARIC certificate & hence I have to mark it No as Gurus have suggested. Hope it helps!

same employer for last 6 months? and then
Earning Same amount continuously,above financial req
Earning NOT the same amount continuously, above financial req

1. Do you remember seeing this ques fortier 2 general 5 year route
2. Is the scope of amount ques 6 months/1 year or 5 years ,if you know?
I mean no one prob would earn exactly same for 5 years!

3. I have heard that someone who ticks NOT the same amount,they go back to ask for 1 year payslip,bank statements.How many payslips and/or bank statement did you ultimately put with your ILR application?

Hi,I am sorry- I am not sure at what point did it seem that my questions are not relevant to Tier 2 ILR.
I have explicitly mentioned Tier 2 General 5 year route in point no 1!

1) You can carry on in the same thread. Its best to keep your history in the same thread.

2) PBS dependent application is pretty simple. Your partner will need to provide cohabitation documents, LIUK, English Requirements. There is no maintenance or income requirements for PBS dependents. There is no absence requirements for PBS dependents if last leave was granted before 11th Jan 2018. Absence limits will come into play for any leave granted after the above only. They will apply on SET(O).
How old is your son??

3) All soft copies are OK. Your partner will need to prove cohabitation for the last 2 years. Need documents from 3/4 different sources evenly spread during last 2 years (from date of application) i.e. every 3/4 months.

Ideally in joint names, if not, you can top up documents with solo names but same address.

For example: Tenancy agreement, Utility bills, council tax, Virgin/Sky contract, bank statements etc.

The checklist will tell you any documents needed for child but since he is only 10, you do not need any SD documents mentioned in the previous link for him.

My partner was on Tier 2 ICT and we all first entered UK on 3 May 2014.
They switched to my Tier 2 General Dependent in UK only in 2016.

For Tier 2 General dependent:
They applied on 19-Apr-2016 and have First BRP date as 25 May 2016.
1) From what I understand is they can apply 28 days before 5th anniversary of First BRP date i.e. 28 Apr 2021?

2) Then this visa was further renewed and next BRP dates are from Nov-18 to Oct-21. However, while they held this BRP I switched jobs/sponsor but they didnt re-apply the dependent visa with me. Thats ok no ?

3) Also, after I got ILR I dont need to switch them to my ILR dependent? they can continue on current Tier 2 General dependent BRP and apply for ILR in Apr?

Also, thinking a little more ahead, you will qualify for YOUR Naturalisation in Oct 2021 (1 year after ILR).

Your partner and and son qualify for ILR in April 2021.

Once you become British, your partner and son do not need to wait at least 1 year on their ILR. So they will presumably save some months.

Set O is the only form a lbs dependent can use.

Adding on:

SET(O) for both partner and child.

1) The form will ask the category:
Tier 2 dependent.

2) The form will ask the relationship:
Partner OR Child below 18 (you will select partner for first form and “child below 18” for other as stated below “note”).

3) Then the form will ask YOUR (Main Tier 2) details.

and carry on......

Note: Make ONE account. Your partner will fill his form. Then the account will allow to add another applicant in the same account also. Then you will fill child’s form.

I have some time before applying for dependents but anyhow starting the work. I have some questions if you can please help with some questions on application form Set O for dependent partner:

1) Main applicant VAF or GWF number? What is that and how can I find it please.
2) Main applicant BRP - shall we provide T2G details or ILR one ?  Mind you T2G one we already cut and returned but we have the scan.
3) For the question - Which visa is main applicant granted: shall we select T2G as it does not show ILR?  
4) Do we need to show old passport for the applicant (dependent)? Old passport was before he moved to T2G dependent but travelled to UK on it when he was on his own T2 ICT visa.
5) Dependent applicant got visa extension on 8 Nov 2018. Do we have to show absences from 1 Jan 2018 or 8 Nov 2018 onwards ? 
6) Dependent applicant's last BRP was until 4 Nov 2018 but new BRP was from 8 Nov 2018. Application was made before previous BRP expiry but we received new BRP later. Will there be any issues or counted as overstayer?

I filled a sample form for my husband and son (Set O for T2G Dependent to ILR). The document checklist only mentions these documents only (surprised so few documents required!)
Spouse Passport & BRP
Son Passport & BRP
Spouse English Test
Consent Letter for verification

Q1: It doesn't ask for co-habitation proof or give any guidance what documents we can submit?
Q2: It doesn't ask for any proof for absences? Their last T2G Dependent visa was granted on 8 Nov 2018. So we provided all absences in the application. What proof do we need to give? Airline tickets or something..
Q3: Last year, My husband applied for Schengen visa through French embassy for business travel. French embassy asked for a letter from his employer. But before we can go further he had to travel to US urgently so he has to withdraw his Schengen visa application made to French embassy. This does not count as visa refused right? Does he need to declare this in cover letter?

Q1. Cohabitation docs is mandatory. The checklist is generic.

Q2. All passport stamped pages have to uploaded for any absence for visas issued on or after 11 January 2018. No other evidence is required.

1) Cohabitation documents are not generated in the checklist. Many have reported the same. But they are mandatory. You need cohabitation documents as mentioned previously.

2) No proof needed except passport.

3) No issue

Yes PBS dependents need very minimum documents.

Assuming you would have mentioned spouse’s LIUK reference in the form.

RE consent forms - submit 2 sets (partner & child) even if checklist does not ask specifically.
