Spouse visa ILR

I’m an Indian citizen married to a British Citizen. I’m approaching my timeline to apply for ILR. Im on a 5 year settlement route.

I have a few questions regarding my application.

I came to the UK on 20 Jan 2016.
With a leave to remain for 30 months

Applied for FLR in 2018
Got another 30 months
My current FLR will expire on 01-06-2021

But I will complete my 5 years in the Uk on 20-01-2021

Can I apply for ILR 28 prior to the completion of my 5 years or do I need to wait 28 days before my current leave expires?


Questions regarding the new Online UKVI system.

Financial Requirement:

I am working on a full-time contract for over 4 years. My annual income is £16800. Which is according to contracted hours (not including overtime)
But I earn less than the financial threshold of £18600
So we are combining my spouse’s employment to meet the financial requirement.

My partner started her job on 8th June,2020. She’s a permanent employee earning £9100 annually.

If I can apply before 28 days prior to completion of my 5 years in the UK then She has been with the same employer for more than 6 months.

Our combine annual income is £25880.

Under category A . We meet the financial requirement as been employed for more than 6 months.

But my question is when I fill both our incomes on the online application. It’s asking me for 12 months payslips.

Is it a mistake on the online system or Do I need to submit 12 months payslips regardless of being employed for more than 6 months?

Please any advice will be more than helpful.

I have done Life In the UK and CEFR Level B1 to prove my knowledge of english.
We have letters of correspondence in joint names from council tax, utility bills, rental agreement and some other letters spanning over the period of 30 months.

Do I need to pay any IHS surcharge?

Please let me know if there are any other documents or any thing that I have missed.

Any help will be very much appreciated.

You can apply no sooner than within 38 days before the 5th anniversary of the date you entered the UK.
Do I need to pay any IHS surcharge?
IHS is not payable for ILR.

Almost everyone has to undergo this confusion due to some inherent hodgepodge stashed on the application form by which you are being asked to supply 12 months of financial documents. Usually only on selecting the option 1, you are being asked for 6 months of documents. Try the option 1.

It’s asking individually

The same amount continuously above the financial requirement amount.

If I choose that one it does gives me the option of 6 months but as I do not earn more than the financial requirement, should I choose that option?

If you aren't intended in supplying the 12 months of documents then yes you can choose that one, and then attach a covering letter spotlighting your calculations along with the reason to choose this option.

I have no issue providing the home office with 12 months of payslips. Its just that my spouse will complete her 6 months with the same employer the same month of applying for the application.

Could it be a issue if I choose no.1 but provide only 6 months of payslips.

During my FLR application I was earning below the financial requirement so we combined both our incomes and gave 6 months of payslips.

So I am a bit confused to how to go about it.

Shouldn't be any issue since the official guidance is still unchanged despite the application form quiver from time to time.
