Visa application FLR-M ( extension ) = 28th Jul 2020
Biometric in person = 22nd Sep 2020
Visa Granted = 6th Oct 2020


In the meanwhile I become
eligible for ILR (10 year route)

Visa application for ILR = 23 Sep 2020


My questions is that why home office did not acknowledge the ILR application before decision and later on sent me visa on FLR-M basis .

Biometric for ILR in person = 5th Nov 2020

Your ILR application is now treated as a new application.

You should chase HO and make a complaint. There was a similar case. HO should have varied it to ILR as it was made before you got decision on your FLR(M).

Had you added any covering letter asking variation into ILR despite the application form ask the same??

Yes cover letter was sent online with all supporting documents.

Then definitely it was preyed on by the caseworker's inattention, and for which a complaint must be made same as advised earlier.

Also note, the team that deals with FLR m is not the same team who deals with ilr.

Your ilr application would only be looked at once biomteric was enrolled and the application submitted by ukcvas.

There was a similar case by user @asap8. Although it was a PBS extension that was varied to ILR, unlike the above, but the concept is the same.

A complaint was raised with HO and eventually HO withdrew their decision on PBS extension and granted ILR. Also the extension fees and IHS was refunded in @asap8’s case eventually.

I am thinking to wait for ILR decision, may be they will themselves rectify their mistake.As one of you said Processing starts when biometric goes so hopefully they will now able to check into this.

When you made the ILR application, did you inform them that you had a pending application?

I applied on 23rd Sep 2020 before FLR M decision and biometric done on 5th Nov 2020.I applied online with all supporting docs and cover letter explaining variation of visa .Actually the processing started now after biometric so just waiting for them to sort this for me.

I believe there is a question on the online application asking if you had a pending application. Did you answer affirmatively?
