SET LR applicant dependent Traveling to India

Hello Experts - Whilst my SET LR is in progress with Home office, can my dependant ( ICT tier 2) travel outside UK? please advise.

I'm aware I can't travel outside, however, what will be status of my wife and kids, they need an urgent travel to India ( may be for a week or 2).

Since SET LR process is chronicles and I'm fall on 11 Oct 2020 and I believe home office still dealing with Aug or early September applicants only. My feel is still they are dependent on current ICT tier 2 visa which has leave to remain till Jun 2021, so they can travel and come back before I get decision with no issue, but experts who can advise will reassure me, please.

Usually the pbs dependants of a sponsor (main applicant) who has acquired ILR through long residence are expected to switch into FLRM as soon as possible otherwise their remaining leave could be curtailed especially on travelling. However, since you haven't yet acquired it (set lr) so maybe that is a different story but still the travelling must ideally be postponed.

Thx Seagul - I have been looking documentation to support why PBS dependant shouldn't allow to travel when they have valid remain on Tier 2 ICT Dependant when main applicant received ILR via SET LR route?

Is there anywhere mentioned PBS dependant visa get curtailed upon main applicant get SET LR ILR?

Hi CR001,

Thanks for the link, I have gone through it. However, its not evident anywhere it is mentioned that, SET LR ILR applicant dependent visa will be curtailed upon travel outside UK.

However, I understand that Dependant should change to FLR M before their current leave expires. But, unable to figure out where it is mentioned that Dependant can't travel and entry clearance restricted with same ICT T2 Visa.

Please clarify, need some important travel for my spouse so your help much appreciated. My SET LR still in progress so just need to understand whilst my spouse return back to UK whether Visa will be curtailed or is it valid with ICT T2 Dependent.

Dependents can be refused entry as the purpose of their visa is no longer relevant if you get ilr based on long residence.

We have had members in the forum report their PBS dependents were refused entry and returned to home country.

Thx CR001, I take your advise. If you get any documentation support this please do share. My spouse need to travel to india in Feb 2021 and I hope by the time I will get my SET LR ILR, so not taking risk to travel without understanding HO rules. Part 8 document for family is not clearly explained so thought you expert may have a document handy.

This forum is so supportive for me.

Application Time for FLR for dependants

Hello Experts,

I'm expecting my ILR ( SET LR) in month or 2 and my dependents (my wife and daughter) have their ICT Tier 2 visa till May 2021. Upon receiving my ILR I need to place FLR (M) for my dependents. could you please clarify my below questions, please?

I need to apply for my wife as soon as I get ILR, reason her employer wants to show visa in place to work beyond May, small firm and they are not accepting or wants to understand SECTION 3C etc... so planning to proceed for my wife. However, wanted to hold for my daughter and planning to place her application one day before expiry of current visa i.e. 29th May 2021.

Question 1: Is it okay for me to place FLRM for my wife as one application and my daughter as one separate application?
Question 2: Is above yes, then what are documents I need to show to support for my daughter application.

Reason to delay my daughter application, they both joined me in UK on Feb 2014, and planning to stretch to get one 2.5 FLRM till Jan 2024 to save some money for at least my daughter application, otherwise I need to place FLRM Extension for both. it would be great if my wife employer understand that, she can work when her visa is in extension if so i can delay for both of them, but as i mention that is small firm and she likes to continue and asking me to place a visa before it expiry :)

Sub question 3: if support FLR M 2.5 years end Dec 2023, would I be still go ahead and place ILR SET LR and proceed Bio-metric 28 days before or I need to place FLR M extension and vary ILR when their qualify period achieved?
