Dear Everyone,
Just trying to help someone as he is not rich.
Someone I met told me he has overstayed visa with his son. Could he apply for his " to stay in the UK" on the basis of Human rights? The son will be staying for 7 years in UK after 8 months. Is it possible? And what are the steps please guys? The son will turn soon 14 or something . Also could the father apply at the same time as his parent? They really want to regularise their stay.
Thanks very much!

Vinny, thanks a lot for your reply.
I could understand that his chances are very low as he is illegally and the child too.
Therefore no lawful way of applying to regularise his stay?

It clearly states what option is available.
Paragraph 276ADE of the Immigration Rules provides that a child may be granted leave to remain on the basis of their Article 8 right to a private life where:
They are under 18
They have lived continuously in the UK for at least seven years (discounting any periods of imprisonment)
It wouldn’t be reasonable to expect them to leave the UK.

Thanks very much!!!!
I am sorry to annoy with questions! But just trying to help the guy.
Actually he told me today he has wife too.
So it is husband and wife and child ( all needs to be regularised )
Have they got a chance? from that article Freemovement I understood that the chances are low , almost at zero ( 0 )??

Two parents.
Note that a non-British child must have resided in the UK for at least seven years.
