Asylum to FLRFP, British child

Post by fprp1 » Wed Jul 05, 2023 9:17 pm

1. Shel initially entered the UK on a dependent visa and during their stay, a child was born in the UK. However, they later returned to their home country for a period of three years. Upon their return to the UK on the same dependent visa, their partner applied for Indefinite Leave to Remain (ILR) and also submitted a Further Leave to Remain (FLR) application for her. Unfortunately, due to domestic violence, the individual and their partner separated. The police were involved in the matter and after investigation, no evidence of domestic violence was found. When She reported the incident to the police, FLR application was withdrawn, She remained without any valid visa for few months. As a result, the individual applied for asylum, which is currently pending a decision.

2. Meanwhile, her solicitors contacted the child's father and obtained his consent for the child's naturalization application based on the father's ILR status. The application for the child's naturalization was subsequently approved.

3. It is important to note that the child, who is now 7 years old, has no contact with their father and has spent most of their time outside of the UK.

4. The individual applied for asylum based on the grounds that they do not wish to live with their partner and also do not want to return to their home country due to pressure from their family to live with their partner.

Question: Can she switch her application from asylum to FLR-FP (as child got British certificate). Child is school going.

Why have you registered a second username to ask the same question?? Multiple usernames are strictly not permitted on the forum!!

Of course it is. Exactly the same static IP address and exact same question.

Decide which username you wish to keep otherwise I will ban both username and your IP address.
