Was he legally in the UK in first place?
He would need a permission from Irish authorities to do that.
On what basis will be go to Portugal legally?
So at the moment he is neither legal right to be in UK nor in Ireland. This is not good.
The fact that you can live there does not automatically give permission for anyone else to live there.
Yes, Portugal and Ireland are in the EU, but Ireland isn't part of Schengen - there's still border control (and I wouldn't expect they'd allow someone without a visa to just arrive and marry).
I got slightly confused about permissions - it's not a permission per se, but there are stages of the process for nonEU/UK nationals specifically.
In the UK you'd need your documents in order as well.You will need to attend an interview with the registrar if:
you are an EU national marrying a non-EU national
one of you is a foreign national
If you give notice without the right visa, the immigration authorities at the Home Office will be told.
The Home Office might:
ask questions about you and your relationship - if this happens you may need to wait up to 70 days before getting married or forming a civil partnership
decide not to approve your notice - if this happens you cannot get married or form a civil partnership in the UK
He needs a visa to travel to the UK.
So on what legal basis is he in Ireland then? Did he get an Irish visa?
