Algerian and uk citizen

Post by Babbhbh » Thu Feb 15, 2024 11:55 am

Hi, I've been with my boyfriend for 8 months, in uk, (im a uk citizen) before he went to Ireland to apply for asylum. I came with him, but he is in accommodation facilities and I have been getting cheap rooms, and going back and forth to work to uk... its getting very tiring but we are very serious about the relationship, and we are doing everything to not let it go. What are my options?
I dont have a work life set up in ireland, my work is in uk.
Is there a way we could live together in ireland?
Could we get married in ireland?
Can he travel legally to uk if we plan to marry?
Would it be possible to go to portugal and marry there?because I also am a Portuguese resident.
Im desperate for a solution as ive used nearly all of my savings and now I have to leave him again, to go to uk to work.

Was he legally in the UK in first place?

Could we get married in ireland?
He would need a permission from Irish authorities to do that.

On what basis will be go to Portugal legally?

Why do you want to live in Ireland if you aim to live in the UK?

You can go to Algeria, marry there and he can apply from there for a spouse visa from there to live with you in the UK, assuming he was in the UK legally.

He was here legally on a visa that expired a few months ago.
About the portugal part of things, i dont know to be honest, its just another possible option, as i have residency, and maybe legally it could work? Im very bad with legalities and such, i just know the basics, like dont kill, dont steal, and such hehe. Im not a pro...
Just wondering if maybe from ireland it would be easier to go to portugal since its in the eu...or maybe it has nothing to do with it.. thats why im asking on here.
So youre saying he would need permission from ireland to get married in uk? Or even in ireland?
Thanks for the answers x

So at the moment he is neither legal right to be in UK nor in Ireland. This is not good.

The fact that you can live there does not automatically give permission for anyone else to live there.

Yes, Portugal and Ireland are in the EU, but Ireland isn't part of Schengen - there's still border control (and I wouldn't expect they'd allow someone without a visa to just arrive and marry).

I got slightly confused about permissions - it's not a permission per se, but there are stages of the process for nonEU/UK nationals specifically.
If he wants to marry in Ireland, an interview is required.
https://www.gov.ie/en/service/ac59d3-ge ... in-ireland
You will need to attend an interview with the registrar if:

you are an EU national marrying a non-EU national
one of you is a foreign national
In the UK you'd need your documents in order as well.
https://www.gov.uk/marriages-civil-part ... or-ireland

If you give notice without the right visa, the immigration authorities at the Home Office will be told.

The Home Office might:

ask questions about you and your relationship - if this happens you may need to wait up to 70 days before getting married or forming a civil partnership

decide not to approve your notice - if this happens you cannot get married or form a civil partnership in the UK

He needs a visa to travel to the UK.

What UK visa did he previously hold that expired?

Did he leave the UK before the visa expired?

Also, bear in mind that the UK and Ireland share immigration data.

So on what legal basis is he in Ireland then? Did he get an Irish visa?

Let's clarify message here.

Algerian nationals are required to hold a visa to visit both UK and Ireland (each one needs a separate visa).
OP stated "he was here on a visa that expired" -> my assumption was that "here" was Ireland, as that's where person concerned is currently situated, but I don't know how true it is.

OP, please, provide immigration history of the person concerned and answer to CR001's questions, so you can get more meaningful advice.

@Sepahardic This is only your second post on the forum and you are a long way off from having the PM privilege.
