Work start date is more than a month after arrival in UK

Hi,

My wife who is a trainee doctor on a Tier 2 visa with NHS will apply for her ILR later this year and subsequently we as her dependents will also apply. I have a couple of queries with regard to her ILR application:

My wife got her Tier 2 UK visa on 10th November 2019
Arrived in UK on 10th December 2019
Started working with a NHS Trust on 23rd January 2020
Changed the sponsor and started GP training on 3rd August 2021

My questions:

1. As she arrived in UK on 10th December 2019 but started working from 23rd January 2020 (more than a month gap), may it impact or delay the ILR application?
2. Will She qualify for ILR by October 2024 (considering 28 days rule)?

A response on the above will be highly appreciated?

Hi,

Yesterday I completed my application (not yet submitted) for my ILR as a dependent partner. My wife has separately submitted her application and it is under process.

The list that I received at the end of application for documents to be submitted with my ILR application is:

1. My passport
2. Consent form for the Home Office to request verification checks on my wife for joint accounts or third party support.
3. Declaration signed by my wife to confirm consent for the Home Office to request verification checks.
4. My language test certificate to prove the level of English language required.
5. Evidence of my immigration status in the UK.
6. All previous passports, travel documents or national identity cards that I have used to travel to or remain in the UK.

The list does not require me to submit proof of cohabitation with my wife / proof of residence / utility bills, my bank statements, scan copies of all stamped pages of my passports or other documents which people usually submit with their applications.

Therefore, I am a bit confused if I should submit only those documents which have been asked or should I submit other documents as I mentioned above?

Appreciate your help.

Presumably you applied using form SET O?

You are required to submit 2 years evidence of cohabitation in both your names and all stamped pages of your passport.

The checklist is generic. Always follow the UKVI rules and guidance notes.
