Preparing for ILR.

Hi Guys, Hope everyone is keeping well.

Under Spouse Visa, my mrs passed IELTS B1 in July 2022 for Spouse visa extension.

Today i have found out by someone that the B1 test is valid for 2 years where as i thought B1 is valid for life and the expiry date applies for entry clearance.
We are aiming to apply for ILR in December and now i am confused on whether i would need to book another B1 for ILR or the existing (expired B1) can be used for ILR.

Do i need house inspection report from estate agent for ILR?

Will being overdraft with bank make an impact on decision?

Today i have found out by someone that the B1 test is valid for 2 years where as i thought B1 is valid for life and the expiry date applies for entry clearance.
English tests are valid for 2 years. It is the LIUK that has no expiry date. Also, stop listening to 'someone'. An expired test can be used only if it was used in a previous application AND the test and test provider is still on the UKVI approved list. It has nothing to do with entry clearance!!

No. You need two years evidence of cohabitation in either joint names or addressed individually, 3 to 6 sourced spread evenly for every 3 to 4 months.
Will being overdraft with bank make an impact on decision?
No!!

Thank you for your response and clearing things.

My mrs done B1 with IELTS. Checked the approved center list today and The center is still on gov.uk approved center list. The B1 was used for spouse visa extension.

Would i be able i pay the application fee with master card?

Yes, most debit/credit cards are accepted - Mastercard included.

Thank you very much for guidance. I had another question, does the bank account where we will be paying fees (different account) for ilr needs to be the same as the bank statements i will be showing my earning on?

And how old can the employment letter be?
I was sent confirmation of employment letter today and i am aiming to apply on 15th of December. Would it still be valid?

Hi Guys,

Hope everyone is keeping well.

I am aiming to apply for ILR for my Mrs start of December. I had a few doubts and question I needed a bit of assistance on.

Do I need to provide house inspection report if I am living with parents? I was given an answer on this question before as "No" but not sure if the same answer applies to if we are living the family.

I am aware that I need to apply for ILR 28 days prior but not sure whether its prior to the date when visa was granted, 28 days prior to the date of entrance in The UK or 28 days prior to visa expiry date which is in April 2025.

Date of Entry in The UK: 18th December 2019, could you please advise on the date period I should apply for ILR.

Could I also include bank statements for my Mrs as part of correspondence letters?

Mrs also has ENIC comparability certificate for her bachelors which was done in Pakistan, would it be okay if I included ENIC comparability and B1 together?

Do I need to provide reference numbers for initial spouse visa, extension and any rejection? (Insital spouse visa was rejected due to incorrect English "Academic" test reference numnber).

I am on full time job but also do Uber on the side, do I need to declare Uber income?

Do I need to mention Child tax credit on the application?

I initially started working for capita in Jan 2019 and was tuped across on August 2019 which was mentioned in initial and extension visa, do I need to mention TUPE process or shall I keep it simple?

Travel history, do I need to include travel history of last 5 years or last 2.5 years?

There is no requirement to submit a housing report as part of a UK spouse or partner visa application.
Please refer to the official guide on how adequate accommodation is assessed.

The qualifying period starts from the date of your first entry to the UK.
There is no requirement to apply at a certain date or time. The general advice is to apply within 28 days of completing the 5 years, as from that point onwards, they can be granted ILR. However, they can apply earlier, as applicants can benefit from the date of decision.

Note that a 'Statement of Comparability' from UK ENIC can NOT be used to satisfy the English language requirement for a visa application.

No, they have all those details. You may have to declare the refusal, if asked. That is all.

A spouse visa holder has NRPF conditions and so cannot apply for child tax credits. This is only allowed if the settled/British spouse applied under their name. You may declare it if asked about settled/British spouse.

There are no absence limits under the family route. You may be asked to declare long absences from the UK over the last 5 years, but they have no effect on the ILR

• Marriage certificate English and Urdu
• Sponsor Letter
• Cover Letter from applicant

Residence Documents:
• Land Registry of property
• Mortgage Statement and letter from bank
• Accommodation Letter from estate agents and home owner (dad)
• Correspondence Letter for applicant and sponsor of last 2.5 years of letters. 6 letters each year with a gap of 3-6 months
• home owners (dad) passport

Life Events:
• Prove of having a son, photos of family friends, holidays. Photos of everything on a word document
• Sons passport, birth certificate, first birthday photos
• life events photos for 2.5 years.
• Tickets and boarding pass of travelling abroad 2.5 years.

Employment Documents:
• Employment letter of sponsor
• P60 of sponsor
• 6 months’ Payslips and bank statements
• Signed Employment contract of Sponsor

Education Documents:
• Like in the UK URN Number from the test.
• English test B1

ID Documents:

You do NOT have to submit evidence of travelling. For absence, you submit stamped passport pages. For Cohabitation, it is evidence for the last TWO years.
I will be including evidence documents as below:

UKVI know you are the sponsor (spouse who is British or with ILR). You do NOT need a letter telling them that!!

NO, you do NOT submit family event photos for ILR. There is NO requirement or need to do this. They will be ignored. Evidence of subsisting relationship is ONLY your 2 years cohabitation evidence, that is it!

Submitting unnecessary documents that are not needed can delay the application and also cause confusion and the important mandatory documents are missed.

Submit ONLY what is required, NOT what you 'think' is needed!!

I am happy to announce that ILR status have been given to my mrs, we received email from home office yesterday.

On to the next chapter “Citizenship”.
