Can we apply childrens ILR with an expired passport

Hi Gurus, my kids will be eligible for ILR in a few months. But their current (Indian) passports are expiring this month. Due to indian government rules, renewing passport for kids with one british parent is a bit complicated.

So I want to ask if its possible to apply for ILR for children with an expired passport. If so , do we have to explain why it was not possible to renew their passports in time . Thanks in advance

Thanks Zimba, I'll try to get their passports renewed but if not its good to have an alternative in case its not possible

ECCTIS Letter degree certificate in both English and Native Language

Dear Gurus,

I am applying for an ECCTIS letter for my wife. Her degree certificate includes text in both English and our native language, the same text appears twice, first in the native language and then in English.

In this case, would a certified translation still be required? The transcript and MOI letter are entirely in English.

Hi Gurus,

can you please suggest if I can apply for ILR on April 1st 2025 for my wife and kids. Here are her absences, working backwards from April 1st. One of the periods (April 2020 - April - 2021) has a 197 days absence but I understand we can apply 28 days before eligibility and the case officer can consider the date of decision if its more favourable to the applicant.

They have visa till May 14th but I am thinking of applying earlier because the fees are increasing on the 9th April. Many thanks in advance

Year 1: April 2, 2024 to April 1, 2025
Total: 14 days

Year 2: April 2, 2023 to April 1, 2024
Total: 48 days

Year 3: April 2, 2022 to April 1, 2023
Total: 148 days

Year 4: April 2, 2021 to April 1, 2022
Total: 128 days

Year 5: April 2, 2020 to April 1, 2021
Total: 197 days

Year 6: April 2, 2019 to April 1, 2020
Total: 269 days

Year 7: April 2, 2018 to April 1, 2019
Total: 8 days

Are they on skilled worker dependent visas??

If yes, your spouse cannot have more than 180 days absence in ANY 12 month rolling period. It would make her ineligible for ilr.

Hi CR001, yes they are on SW dependent. But since we can apply 28 days before we are eligible , she will be eligible on 17th April if my calculations are correct. Can I not apply on April 1st?

Here are 5 periods of 1 year working backwards from April 1st . The 5th period has an absence of 197 days
Year 1: April 2, 2024 to April 1, 2025
Total: 14 days

Year 2: April 2, 2023 to April 1, 2024
Total: 48 days

Your absence period calculations are wrong. That is NOT how rolling calculations work. You cannot have more than 180 days of absences in ANY 365-day period. There is no year 1, year 2, etc

Hi Zimba thanks for your reply. I get it now, its basically a 180 day absence in any 365 day period between the qualifying start date and qualifying end date (5 year period)

So if I submit the application on April 1st and Decision date is around April 20th (which is very optimistic for a non priority application). Would the end date of qualifying be April 20th 2025, which means the start date of qualifying is April 20th 2020.

I have calculated and there is no 365 day period in this 5 year period which has an absence of more than 180 days. I verified this with Claude AI too which gave me the same answer. Is my understanding correct and I can make an application on April 1st? Thanks in advance

Please ignore this question. I entered no for "Do you have a passport" and then it allowed me to enter the details of the expired passport. Thanks

I can confirm that I have received my ECCTIS certificate today with english language. This may be useful for others in the same situation
