Visa extension for dependants and ILR - main settled under LR route

Hi Moderators,

Need your help and advise.

Main applicant settled under 10 year LR route but was on SW visa when settled.


Dependants SW dependant visa extension is due by end of this month 30th Sep. And they will be completing 5 years by 12 Jan 2026 (visa issue date 12 Jan 21, arrived in UK 18 Mar 21)


Below is my plan to save some visa cost but not sure if it works and hence need your expertise.

- Apply for visa extension for wife and kids separately (default is 3 years?) and guess it can be separate applications?
- Enrol biometrics for wife and get the visa extended ASAP, as she need to travel in November.
- however, for kids do not enrol biometrics and vary the extension to ILR (to save some cost) within the 45 days window 01 Dec 25

- Apply for Wife's ILR as new application in December 01 Dec 25 and enrol biometrics 28 days before completion of 5 years (16th Dec 25)

- enrol biometrics for kids after completion of 5 years (12 Jan 26) but within 45 days window - just to ensure it's 5 completed years when case worker makes a decision.

Does this work? Or is there any issues with with this plan and will it have an impact on the ILR decision.

Also when applying for kids ILR does both parents need to have the ILR or is it OK to have an ILR application in progress, as wife's ILR decision might not be confirmed by the time I apply for kids.

There is no minimum 5 years residence for children. They can only get ilr when both parents are also applying or both parents already have ilr.

Thanks @CR001.

Does this mean my plan will not work as you must have the ILR even for varying the child application (point 3) or are you suggesting that the child don't need to wait until 12/Jan/26 to complete 5 years to apply for their ILR (point 5) and can apply earlier ?

Also when varying the ILR application for kids does this ask for ILR reference of both parents? Or just the application reference for wife ILR will do as her ILR will also be in progress in that window ?

In addition to the above post, below are the key dates for my adult dependent and child.

Visa valid from - 12 Jan 21
Arrived in Uk - 18 Mar 21
Type - Dependent Partner
Visa valid until - 02 Oct 25

Earliest ILR eligible date
12 Jan 26 - 28 days = 16Dec25
can apply for ILR after this date.

Now timelines to process for Adult dependant :
Apply for SW extension and submit application - 10th Sep 25
Don't apply for child, just yet(timeline below)
Biometric dates - enrol ASAP
Try and get Visa extension ASAP

Need to travel outside country end of October/November. On return.

Apply for ILR - 01st Dec
Enrol biometrics 16 Dec 25 via
Priority service to her decision in a week's time.

Timelines to process for child dependant :
Apply for SW extension and submit application - 30th Sep 25
Biometric dates - do not enrol and delay but apply for variation just within 45 days.
Submit varying application for ILR - 01 Dec 25. This is same date as the Adult dependent's ILR application - will this be allowed/possible to apply ?
Biometric dates - wait until Decision on adult ILR Application and hopefully the decision will be done in a weeks time as priority service.

Does this sound OK.. Will this work?

It should work.
Note that for the child ILR, the form SET(F) has to be used.
For your spouse ILR, you have to use form SET(O) as usual.

Am I right in understanding that when one of the parent is applying/applied for settlement but no decision yet, the child application will also use set(O) although they are under different applications.

Reason I ask is because my partner will apply for her ILR on 1st Dec and am planning to vary the existing child application from extension to ILR on the same day, 01st Dec.
... still will be using set (O) for all?
