Hi,

Can I have some advice please?

I am Chinese and has Indefinitely Leave to Remain in the UK. I had my baby in September 2015 in Shanghai. Baby's father is in China and he holds a Chinese passport with no UK visa. We divorced in May 2016 and I have the custody of my child.

I am now back to the UK and have returned to work as my maternity leave had ended. I am currently renting through a friend and I don't own a property. what I would like to know is whether I can apply for indefinitely leave to enter for my child straightaway or do I have to go through the whole process of getting him 'join a family member' visa? If that, how long will take him to the settlement.

I would be very grateful if you experts could help me on this.

Child would have been British if born in the UK, as advised in April 2015.

What if I am not in the UK after I submit my Application (click)

You will need to apply for a Child Settlement Visa. You will need to provide official documentary evidence that you have sole responsibility.

Thank you for your reply. I am wondering how I can prove my sole responsibilities, what exact documents that I need to provide in order to prove this and meet the requirement.
