Spouse Visa Refusal because of wrong IELTS

Post by wqshabbir » Tue Aug 23, 2016 10:00 pm

Got refusal letter because my wife did the normal Academic IELTS instead of 'IELTS for UKVI' or 'IELTS Life Skills A1'.

ECO Reasons for Refusals
• You are not exempt from the English language requirement under paragraph E-ECP 4.2. In addition, you are not a national of a majority English speaking country listed in paragraph GEN 1.6.
• Furthermore you have not passed an English language test (Al Level of Common European Framework) with a provider approved by UKVI. You have stated that you meet the English language requirement as you have provided an IELTS test certificate dated 03/03/2016 I note, however, that from 23 April 2015, UKVI required applicants to submit results from an "IELTS for UKVI' test that was completed at an IELTS test centre authorised by UKVI to run IELTS tests for UK visa and immigration purposes You must confirm at the time of registration that you wish to use your test result for these purposes. The IELTS test result you have provided is not recognised when attempting to verify your results on the UKVI IELTS website I am therefore satisfied that the test certificate you have provided is not an “IELTS for UKVI" test
• In addition you do not hold an academic qualification recognised by NARIC UK to be the equivalent to the standard of a Bachelor's or Masters degree or PhD in the UK, which was taught in English I therefore refuse your application under paragraph EC -P 1.1(d) of Appendix FM of the Immigration Rules (E-ECP.4 1)

We have been given 28 days appeal right.

Now my wife booked IELTS Life Skills A1 and result will be delivered well in time which means we can go for a appeal. Also getting UK Naric letter Visas and nationality letter for BSc(Hons) degree which she finished in 2012.

My Question to all of you.
1. Would IELTS Life Skills A1 evidence be acceptable in this case which is post-dated refusal letter?
2. Would UK Naric letter be acceptable which post-dated refusal letter. Please note degree was done in 2012 and its uk naric approving now that it is equivalent to UK bachelors and taught in english.

Please advise and thanks in advance!

Please don't send me PMs asking for immigration advice on posts that are on the open forum. If I haven't responded there, it's because I don't have the answer. I'm a moderator, not a legal professional.
