Financial requirement needing to be met 3 separate times?

Post by Bas100 » Wed Jan 18, 2017 7:19 pm

Hi all,

Am I right in thinking that the 18,600 pounds per year threshold, as well as the other requirements, all have to be met at each waypoint on the 5-year spouse visa route?

-At the time of first application
-Further Leave to Remain after 2.5 years
-Indefinite Leave to Remain after 2.5 years and 5 years in total

Working 2 jobs/working 6 or 7 days a week was one possibility for me to meet the financial requirement but may become untenable for family life (ironically!) over 5 years.

Thanks in advance!

It will need to be met for the 2.5 year renewal, not sure about ILR. Your spouse can get a job and their income can be used towards the 18,600 once they are in UK.

Financial threshold requirement need to be met on two occasions such as initial application and second (extension) application but I think there is not yet any financial threshold requirement for ILR application. HO don't care as how many days/hour's you have to work except they only concerns about the required threshold. You may meet that requirement by doing one job only and usually in case of non skilled job one need to work longer hours but in case of skilled job usually you work short hours/have more off days which can yield the required threshold (it's a general job trend).

The same financial requirements are required to be evidenced for ILR.

Ok, thanks so much guys!

Another thought, and one I think would be relevant for many others too. The scenario: Successful application is made for Spouse visa but before I can apply for a FLR, the income requirement is raised, thus making me ineligible for that extension and of course, the ILR.

I guess it's impossible to predict, but based on previous experience, anyone have any idea whether someone applying under old rules would be protected and allowed to continue to the end of the 5-year route with the old rules in the event of rule changes like this?

I think it's only a matter of time before they raise the threshold, unless BREXIT gives them leeway to relax the rules or that (long lost)MM case is won. It'd be a killer for us to leave our jobs here, uproot our lives, apply successfully only for the income requirement to be raised before FLR or ILR is reached and then have to return to where we had originally left to start again from zero.

Prior to the current income requirement which started in July 2012, there was no minimum income requirement to be met.

No plans at present to increase the income requirement. There are sometimes transitional provisions, but not always. Suggest plan accordingly.

Brexit has nothing to do with the UK immigration rules, it affects the EU route of immigration.

HO will likely not 'relax the rules'. There are other FLR routes, at present, if income requirement is not met.
