Citizenship for kids living separately !

Post by paulsandy » Sat Feb 11, 2017 1:44 am

Hi Moderator or colleagues here,

I came into UK in 2008 under highly skilled visa .Then it was converted onto Tier-1 automatically. My kids have been living with her since I had broken up with my wife in 2011 .I have got my citizenship already two years ago .But now I have heard that my kids are struggling to get citizenship. They are now on 10 year route.Initially they were under my dependency but my ex-wife took them on her own way and never gave me chance to see them.Is there any way out that I can claim their visa under my categories so that they could get citizenship now ?
Thanks for your help.
Regards
Paul

Unless your kids were born in the UK, the UKVI expects them to have ILR, etc., prior to applying for citizenship.

Hi Vinny,
Thanks !
They might still be on the extension of visa for 10 years route of ILR and 11 yrs for citizenship. My concern is that I got ILR in 5 years and citizenship in 6 years. They just became the victim of not living with me.Therefore may I request and apply UKVI for their ILR now?.Note they are still not with me though .My ex-and myself made them victimized.
Thanks again .

No you can't. They will have to follow the visa/immigration path that they are on now and will qualify for ILR when the other parent does.

If they meet all the requirements once they have lived here for 10 years, they could apply for ILR based on long residence, provided they have not had periods of overstay, excess absence etc.
