Documents translation for FLR (M) application

Post by return_l » Thu Apr 06, 2017 4:16 pm

Hi,

I have an urgent question and wonder if anyone can help me. My wife is in the process of applying FLR (M) for the 1st time and some of the documents are not in English or Welsh (like marriage certificate). Where can we get them translated to meet the immigration rules? As according to the Appendix FM-SE (shown below), it has to be independently verified.

Thank you so much guys.

Sincerely,

:o :o :o :o

(j) Where any specified documents provided are not in English or Welsh, the applicant must provide the original and a full translation that can be independently verified by the Entry Clearance Officer, Immigration Officer or the Secretary of State. The translation must be dated and include:
(i) confirmation that it is an accurate translation of the original document;
(ii) the full name and original signature of the translator or an authorised official of the translation company;
(iii) the translator or translation company’s contact details; and
(iv) if the applicant is applying for leave to remain or indefinite leave to remain, certification by a qualified translator and details of the translator or translation company’s credentials.

Why is she applying for FLR(M) - which will reset her clock to zero for ILR - instead of extending her PBS Depndent??

I changed my status to ILR Oct 2016 from Tier 2 General. She was on PBS dependent before for 3 years. Can she still extend that even though I am now a settled person?

She can continue to extend her PBS dependent until she meets the 5 year residence requirement for ILR. The rules allow her to do this and she will get a 3 year extension.

Oh, Thank you so much for your help. I am so happy that I posted the question before we sent the application.

But I just went to www.gov.uk website, I could not find where to do this PBS extension. Would you mind sending me the correct link please?

I also found this link (https://www.whatdotheyknow.com/request/ ... _dependent) from another forum, which is exactly what my situation is. But the reply from HO office is that very clear.

Online application only. She can apply in person or by post.

Yes, your second link says exactly what I said.

Great. Thank you so much CR001. Forgive me to be a pain to confirm this again.

So although it says "Apply to extend or switch your visa or leave to remain as the spouse, civil partner, unmarried partner or same-sex partner of a Tier 1, 2 or 5 worker or Tier 4 student.", and now I am no longer Tier2, she can still use this to apply?

Hi CR001, sorry to bother you again. I am now reading the 319C. One paragraph says that:

(k) Where the applicant is 18 years of age or older and seeking entry clearance as the partner of a person specified below, the applicant must provide either an original or scanned copy of a criminal record certificate from the relevant authority in any country in which they have been resident for 12 months (whether continuously or in total) or more in the past 10 years, while aged 18 or over. This requirement does not need to be met where the Secretary of State is satisfied, by way of an explanation provided in or with the application, that it is not reasonably practicable for the applicant to obtain a certificate from the relevant authority.

Is this a new thing? Because I am sure we did not provide this for my wife's last PBS extension, which was about one year ago.

Many thanks.

Hi CR001, I am helping my wife fill the form of PBS dependent online. Although I selected "Yes" to the question: "Do I have indefinite leave to remain or British citizenship?", It still asked me "What is the length of my CoS".

Is that to do with my last CoS before I got ILR? Many thanks.
