ETS/TOEIC out of country spouse appeal...

Post by waitingindefinitely » Wed Apr 05, 2017 9:15 pm

Hi everybody

I just wanted to know if anyone has had any success in winning a out of country toeic related appeal?

My husband was refused FLR via private life route back in November 2015 because of this whole annoying toeic issue... He was detained and then voluntarily left the country after we were told that our jr wasn't successful. We submitted a new application from Pakistan last year in August which was refused again in December for the same ets allegations but we were given out of country appeal rights...

January 2017 we submitted our appeal.... In February we received our notice of pending appeal.... With our deadline being 26th May 2017....this week marks 7 weeks when usually lucky applicants find out if they have been successful at review stage obviously we haven't looks like we will be going to court for this

I just wanted to know if anyone else is in the same boat as me?
Is anyone else struggling quite frankly I think it's so unfair that home office are refusing to accept that their so called evidence is completely irrelevant and unfair... This whole blame is unfair and i dont think home office give two ***** about the pain and struggle they are putting us through.... This whole process since November 2015 till this date has costed just under 15k ; literally wasted.

Did he do the TOEIC himself or did he use a proxy??

Have you requested the audio evidence from HO??

He sat the test himself...

With the voice recordings matter whether we have them or not it makes no difference to our nor anyone else's cases as so many judges and voice experts have deemed the evidence as invalid... They send the same generic voice recording to everyone who requests it.... It's all down to how fluent the person can speak English and what motives would the person have to actually cheat in such an easy test...

I understand that BBC panoramas investigations undercover ed that fraud was involved at some test centres but all those people have been caught out.... That was a minority of people not the whole majority who took the tests.... It really is plain unfairness... They don't even look at evidence we provide and they won't admit that they are wrong either to accuse us all... Justice is going to be sweet.... One day when we have won all this.

Hearing date..

Post by waitingindefinitely » Fri Apr 07, 2017 5:41 pm

Hi everyone can someone please tell me what this email means

Thank you for your email.

I can confirm that to date the Respondent has not overturned their original decision. A copy of their bundle was issued to your representative on the 22 March 2017.

Please note that we are unable to provide timeframes for the appeal process (as a whole or each procedure within the process) due to a number of varying factors.
The Immigration and Asylum Tribunal actively uses feedback to improve our delivery and provide you with the best possible service. Your input is very helpful to us in reviewing our processes

Our deadline was for 26th May 2017...i understand that decision was not reversed therfore will be going to court but what I don't understand is why they issued bundle so early?? Does this mean if we are lucky I can get hearing date before 26th May?

Hearing date

Post by waitingindefinitely » Tue Apr 11, 2017 11:29 pm

Hi everyone, if you've been following my post latest update is that our appeal review wasn't successful and will be going to court.... We received our ecm review refusal letter I'm just a bit confused is this the so called bundle as well or is that something else?

Also is there any way of getting a hearing date faster... I know many people will say be patient and it's not only my application there's plenty more but it is a question which ponders through everyone's minds

What exactly is in an appeal bundle?

Post by waitingindefinitely » Wed Apr 12, 2017 6:22 pm

Hi everyone

Can someone please confirm what exactly is in the home office appeal bundle... Is it supposed to be all your documents and immigration history and any correspondence you have done with home office?

Or is it supposed to be evidence... Because we have received our bundle and it's just lost of files relating to my husbands immigration history.... There was no evidence at all... Our is ets related appeal and I was expecting some form of evidence but there isn't any

I'd be really greatful if someone can please confirm what exactly is a appeal bundle please

Hey everyone, I emailed the Tribunal toaak them if they could speed up in giving me a hearing date and they replied with

We can confirm that your enquiry in relation to the above appeal has been passed to the relevant department to be dealt with accordingly.

The Tribunal aim to respond to all correspondence within 10 working days from receipt, therefore please allow time for the Tribunal to respond before chasing a response.

How legit is this reply? Is it a standard reply they send to everyone or is there hope for a quicker date?
