Length of time / passport return

Hi,

To cut a long story short I'm English and my wife is Brazilian.

Thinking life regards visas would be easier we came to the UK February 2016. We came hastily back as at that time there was the threat of the Zika virus on pregnancy in Brazil and my wife was pregnant. My wife entered on a tourist visa and we thought it would be easy enough to sort the rest out in country, U.K.

We applied in July 2016 under the ten year family visa flr fp. Our son was born in September 2016 in the U.K.

It's now been 11 months and we've heard nothing other than request for biometrics. Finding out any information is impossible other than the new website they've set up (awaiting a decision currently).

There's the above plus,

I requested my passport back now 3 weekend ago as I need to travel. I've no idea where my passport is as I still don't have it.

Question:

Can I report my passport lost / stolen and get a new one?

Also is 11 months completely crazy or is it the norm?

Note we'd do it all again as our son has been born healthy and free from the affects of the virus.

It can take many months and more than a year, especially due to her arriving as a tourist. It is not permitted to switch to any other visa category if in the UK as a visitor so the application will likely take a long time and possibly be refused.

Did you/she pay the full bill for the birth if NHS was used?? She would not have been entitled to any free NHS usage.

Any information reference my passport issue?

We paid the full NHS surcharge yes.

We were also very aware the visa might be refused but as said, at the time, it was our only option. Returning to Brazil was not an option for us as the zika virus was prevalent and we didn't want to cause risk to, at the time, my unborn son.

Although aware the visa might be refused I'd like to think I did a near perfect job in terms of the application whilst amongst other things show that we clearly met every box we needed to tick other then my wife was in country on a tourist visa.

It's all worked out to be a real shame to be honest, if it was to be a refusal it would have made much more sense to issue this to us months ago where by now my wife could have returned, applied properly, and been back by now on a proper visa.

If your wife arrived as a tourist, she needs to pay 150% of the actual cost of the NHS services used while she was here as a tourist. If these charges are not paid, that can also be grounds for refusing a visa later on.

Guys,

Again thank you for the reply. This was not something we were made aware of but will look into it certainly.

I'll stress. As we had no option we'd do it all again.. would you want your baby, if you could prevent it, contracting an illness which will lead to deformity and brain damage? No.

Anyway, I've requested my passport back twice but don't have it. Can I just get a new one? there is no one in the Home Office to talk to about this as I'm sure you know, we've been trying for 11months. :)

Most of us have jobs and families. We don't sit on the forum all day waiting for members to post.

If she has used the NHS for the birth and not paid the bill, you might have a big problem. Why you suddenly left Brazil is irrelevant to this fact.

If you want advice that badly, you should be contacting a solicitor instead of relying on a free forum. And to answer your question, you can't report your passport as lost when it actually hasn't been lost. There is also a procedure to report the loss of your passport here: https://www.gov.uk/report-a-lost-or-stolen-passport

And making a false claim that your passport is lost/stolen is a criminal offense. HO will know immediately that you're making a false claim and may further delay your application process.

If HO lost your passport, they have proceedings that will inform you of the loss.
