General or Shortage Occupation visa category

Post by ellebar_yam » Sat Jul 22, 2017 5:50 pm

I'm interested to know what Navanee applied for instead? Which between Tier 2 General Visa and Tier 2 General Shortage Occupation Visa did you applied for and was it approved?

I'm also about to apply for my Work Visa and my job is listed in the Shortage Occupation list set forth by UKBA, but since my employer is sponsoring for the first time I'm afraid I wouldn't get any great answer from their HR. I know they applied for Tier 2 "General" visa but if I apply for the Tier 2 General Shortage Occupation Visa will my application still be approved? I really would like to insist on applying under the Shortage Occupation one because it's a lot cheaper and I can save the extra money and use it to survive in the UK for my first month if I apply for this type of visa. So it would really be a great deal of help if Navanee would answer my questions.

Thanks a lot in advance.

You can check the COS issued by your employer.
The COS has a line - "Is the job on the current shortage occupation list?: Y". My COS has it and I applied for Shortage Occupation Visa.

Please make sure the type of visa that you apply for matches with the one mentioned in the COS.

My Employer can't provide me the CoS printout of details

Post by ellebar_yam » Tue Jul 25, 2017 8:56 pm

Isn't it the Cos is just a number? How can my employer provide me with the CoS details printout? Is it computer-gnerated from a website or do they just collect all information needed where they can just base the format details from one of the available document from just googling how a CoS looked like? I knew that my employer was new to sponsoring employees and now they have difficulty providing me with the CoS printout. Did anyone here approved of Tier 2 Sponsorship Visa even without the CoS printou? Please I hope someone could answer me because the person handling my application right is on vacation and I'm running out of time ... Thank you

Employer not ticked the maintenance fund but I need it

Post by ellebar_yam » Tue Jul 25, 2017 9:12 pm

My employer is a first-time sponsor and they're A-rated sponsors. In the generation of my CoS, they did not tick the maintenance fund, however I need them to state that they will financially support me because I wasn't able to meet the 90-day personal savings. Will my tier 2 sponsorship visa still be approved even though they didn't tick the maintenance fund but they're A-rated sponsors? Because according to the provisions stated in the Tier 2 UK Visa Guidlines, the applicatant will not be needing to provide bank statements because sponsor is A-rated, but the catch is they didn't tick the maintenance fund... Did anyone here had this kind of experience? It'll really be a great help if someone could advise me on this. Thank you

It does not matter if they are A-rated or Premium rated. They have to specify in the COS that they'll financially support you.
If you cannot support this requirement yourself your visa will be refused.

Check with your emplyer if they can add a note to the COS that they will be supporting you otherwise don't apply.

Please put some line break as your message is very difficult to read.

What is COS? It's a certificate of Sponsorship.

Its not just a number. Its a certificate which holds all the information required for your Tier 2.

Some of the things like

* Salary
* End date
* Start date

etc.

I don't think so you need to print out the COS for your tier2. In tier2 form you just specify the COS number and rest they'll access it from their system.

Can you please keep all your questions on the same application in ONE topic, this one. It is not necessary to start a new thread with each query.

I'm really sorry about the multiple topics with crowded statements. I figured I might overwhelm the people who'll be able to read my post if I make it longer, but thank you for the reply.

Yes, CoS here is transcribed as Certificate of Sponsorship and I am well aware that the CoS number provides a lot of important details, but what I don't understand is why my employer insists that they just received a number and there's no details to print out. Futhermore, if there really is a hard copy of the CoS details, why won't my employer just give it to me so I can apply for my visa?

Please bear in mind that it's my employer's first time to sponsor anyone and because of this they're still a novice in providing information for my visa application, that's why I'm doing my research and asking around. Thanks again for your replies ...

Thanks for this, one more question:
Since I already have a CoS number but they didn't tick the maintenance funds, they won't be able to edit the CoS in order to tick the maintenance fund right?

How long can an employer withdraw a RCoS and re-apply again?

Post by ellebar_yam » Wed Jul 26, 2017 5:07 pm

How long can a private institution employer withdraw or cancel an RCoS (Restricted Certificate of Sponsorship)? Because I need them to make it in time for the monthly schedule of deadline for submission of RCoS.

They need to withdraw my current RCoS because they didn't tick the maintenance fund. At fist I was all right because I thought my personal savings would be enough; however, I just recently learned that it will not be able to meet the 90-day holding of £945 before I apply for a visa, that's why in the end I need them to tick the maintenance fund in the RCoS.

Thank you for any advice on my situation

Withdrawal of Out-of-Country RCoS Maintenance Fund Issue

Post by ellebar_yam » Sat Jul 29, 2017 5:57 pm

Hello, I hope everyone's doing great. I've been reading most of this forum since I'd started online job hunting in the UK and this has helped me a lot. Now that I already have my Restricted Certificate of Sponsorship (RCoS) I thought everything will run smoothly for my visa application.

I'm about to apply for my Out-of-the Country (in Saudi Arabia) Shortage Occupation Visa but my personal savings won't meet the 90-day period which should've held the required sum of money and at the same time my employer stated "N" in maintenace fund in my RCoS.

They didn't consult me when my employer applied for the said certificate. At first I was ok with it because I know I have money but because of the 90-day period, that bank account of mine won't be approved by the UK Immigration thus I need my sponsor to ammend my RCoS and state in the Sponsor's Note that they'll support me for my first month.

I've spoken to my employer and told them to just ammend it because I have no problem supporting myself and I just need them to do this for the sake of formality; for the requirement of UK Immigration. But eventually, they decided to withdraw my current RCoS and re-apply for another one because they feel that my application would'nt be strong enough and just ammending it and just stating it might cause my visa to be denied.

I wouldn't have any issue with this if I have a lot of time here in my current job in Saudi Arabia. My story here is I'm about to renew my contract but I chose UK. Now, I'm about to exit Saudi Arabia by 2nd week of September since I didn't renew my contract because I thought my UK visa application would make it in time. But with the way it's turning out right now specially with the re-application of RCoS, which I hope they'll be able to withdraw my current one soon and apply again within 5th of August, if not then maybe they'll be able to issue my new one by September and I'll be going back to my home country by that time. And to make matters worse, the person in the HR who's in-charged of my application, is on leave and they said that he won't be back till the 4th of August. I did persuade them to temporarily assign anyone in order to withdraw my current RCoS and make it in time for the monthly allocation which is every 5th of the month and I really hope they did. I haven't heard from them sice the previous week.

I also want to add that my employer is sponsoring anyone for the first time, that they applied for License to be a Sponsor in order to give me an RCoS. I assumed that because it's their first time, they have limited knowledge of the whole application. Now they know.

My concerns are:
1) Has anyone had their Tier 2 visa approved despite the "N" in maintenace fund and only the sponsor's note to prove your company's financial support? Was your employer able to change the "N" in the maintenance fund to "Y" though an RCoS number was already assigned? Because if this is the case then I can stop my employer from withdrawing my current RCoS and proceed to visa application immediately.

2) If my RCoS really needs to be re-applied due to the maintenance fund, does anyone here know how long would it take to be withdrawn and can they re-apply immediately in time within the 5th of August?

3) Is it also true that there are sponsors only given one (1) CoS per year? I've read it somewhere in this forum website. Please note that my sponsor are first-time and small-scale sponsors but according to the UK government website for registered sponsors that they are indeed "A-rated" sponsor. Not that I know these information would help answer my question, but what are the chances my employer would be given this allocation?

4) Also because they're "fist-time and small-scale" sponsors, they don't have they're own accommodation, which is also a requirement before I appy for visa. Does anyone here know how I can help my employer to find me an accommodation? Do I need to worry that they'll have difficulty finding me a room to be rented since most of the landlords in the UK need references and credit checks before I'll even be shortlisted in their tenant applicants?

I know my visa application story above is a bit long, but the administration of this website kept on merging my short questions into the very first topic I had ever joinrd and then my respondents get's lost.

Or if anyone here had undergone the similar situation. It would really help me a lot for any advice.

Thanks in advance for your replies.

Topics merged again!! This is the 3rd time you are being asked to keep ALL your questions on the same application in a SINGLE topic (THIS ONE). Is there a reason why you believe the forum rules and guidance do not apply to you??

Your posts you have tagged on to other members topics asking maintenance fund questions have also been removed as the posts you tagged onto are more than 4 years old. Please refrain from digging up old topics with outdated information.

First of all I apologize that any of my actions has caused something to this forum. I trusted my judgment that since my message is longer and more detailed that this time I can start a new topic to avoid confusion if I had included it here in this thread because I noticed this particular forum is already full of unanswered concerns. I'm sorry if my lack of the moderator's preference and too much care for other's ability to be able to comprehend my message had got me this time.

Second, if you notice I have dug up old threads because I have already read most of the latest topics but still I can't find the answers to my concerns, that's why I resorted to stating everything and taking up much of my time into typing this in order for anyone to see it. If you could kindly answer some of my concerns from my long message that'll be fine.

Please, there's no need for hostility. I'm also trying my best to abide by the rules. Thanks again.

When someone is able to answer your questions, I am sure they will. Most members we have who are familiar with the ins and outs of Tier 2 General might be on holiday or busy.

I don't have the answers so have not responded to your questions.

I am not being hostile, but you have been asked repetitively to keep your questions on the same application in a single topic.

Digging up topics from 2013 and 2014 clutters the current forum and the rules may well have changed and those topics are likely outdated, which can cause confusion.

Re: Withdrawal of Out-of-Country RCoS Maintenance Fund Issue

Post by ellebar_yam » Thu Aug 03, 2017 7:59 pm

Hello again, I hope everyone's doing fine.

Regarding my concerns, particularly the maintenance fund not being ticked in my restricted CoS, my sponsor amended it in the Sponsor's Note for the same CoS number. I was surprised because they didn't have to change the CoS number. Based from the other topics I've read from this website, some advised to re-apply for a new Restricted CoS. Can anyone help me please, because I am actually running out time to apply for my visa. Will this unticked Maintenance Fund be easily amended by an employer through SMS, takin into account that it's a Restricted Certificate of Sponsorship?

Also, they entered "Y" in the section that says: Does the migrant need to leave and re-enter the UK during approval? Can anyone explain this to me please, before I tell my sponsor to change this to "N". Because from what I had understood from reading other topics such as like this in this website, it needs to be "N" in order for me (the migrant) to be able to travel out of the UK particularly to my home country Philippines during holidays or annual leaves. Did I understood it correctly? Can anyone tell me that I need to tell my employer to change it to "N"? If not then can anyone explain that section to me if I leave that "Y" as it is?

Please help. I really am in need of professional advice right now. And thank you again for letting me express my concerns and I'll be forever grateful to anyone who would be able to help me with my concerns. Thank you again

A note is fine. No need to ask for a new cos .
Just to be on safe side, u can ask them to give u a letter explaining that they will sponsor you for maintenance for 1 month.
The other question is regarding leaving and entering the country on business visits. Its fine if they have ticked yes.

Thanks a lot iworker! Thank you for answering both of my questions.

I'm sorry but if I may I would like to ask another question regarding accommodation. In the Sponsor Note on my Cos, my employer had just included a certain amount of money to serve as my Maintenance Fund to help me settle in the UK during my first month of employment, but the accommodation is not included. Will this be a problem for my visa application? Do I need to request my employer for accommodation details for me to submit this for my visa application? Or will the Sponsor Note of Maintenance Fund be sufficient?

Thank you again iworker. I really appreciate your reply.

Hi ellebar_yam,

I have a similar situation but my employer was not able to add any sponsor note. Were you successful with your visa if you submitted the letter even though on the COS was a 'N' for maintenance?

Would appreciate your feedback!
