Clarifications on Tier2 General visa

Post by dewdrops1420 » Mon Apr 03, 2017 3:33 pm

Hi,
I'm going to apply Tier2 General visa from India in May.Right now,I'm on Tier2 ICT dependant visa valid until Apr 2018.My hubby is the main applicant of the latter visa.
1. Could you please let me know if my hubby and son can switch to Tier 2 General visa in-country(UK).
2.Also will my hubby be able to apply for ILR in 2021 as he is in UK since 2011 on Tier 2 Skills transfer visa(May 2011- Nov 2012) and Tier 2 ICT(Apr 2013 to Apr 2018) and Tier 2 General from (May 2018 to May 2021).

Thanks,
Dewdrops

Do you mean Tier 2 General dependent??? If yes, once you return to the UK yes he can.
2.Also will my hubby be able to apply for ILR in 2021 as he is in UK since 2011 on Tier 2 Skills transfer visa(May 2011- Nov 2012) and Tier 2 ICT(Apr 2013 to Apr 2018) and Tier 2 General from (May 2018 to May 2021)
Yes, provided he meets the requirement for ILR based on long residence including the more restrictive absence limits. You need to clarify the gap in 2012/13 as this might be an issue but I will have to look into it.

Thanks a lot CR001.
Prrsent employer of my hubby is willing to give him clarification for the gap of 2012/13.
But even if my hubby switch to Tier2 general dependant visa and start working for another employer, still for ILR, is continous residence in UK the key factor?
We are confused as we read somewhere that for ILR, one has to be in same visa continuously for 5 years. So does that apply even if we apply after 10 years also?

Yes, for ILR, it is either 5 years as t2g or 5 years as t2g D. You cannot combine the time from depression and main visa to make up 5 years. It will only count for long residence ILR.

Documents reqd for Tier 2 General Dependant visa in-country

Post by dewdrops1420 » Fri Aug 11, 2017 9:52 am

Hi,

I want to apply Tier 2 General dependant visa for my hubby and son from UK.They are currently in Tier 2 ICT visa.
I know that we need to send the original documents by post.So was wondering if I need to send my original passport and BRP card or just the copy? Please can someone verify the below list and let me know if I'm missing something or something in the below list is not required.

1. The new visa application
2. Certificate of Sponsorship of main applicant
3. Offer Letter of main applicant
4. Last 6 months Salary slip of main applicant
5. Passports and BRP cards of main applicant and dependants
6. Marriage Certificate
7. Birth Certificate of my son
8. Council Tax and Last Bank Statement of my husband proving the residential address
9. 2 colour photographs of dependants

I'm bit worried since all the above originals are sent by post.

Thanks and regards,

Maintenance certification for Tier 2-General dependant visa

Post by dewdrops1420 » Fri Aug 11, 2017 11:22 am

Hi,

I have applied and got Tier 2 General visa in June.My sponsor has certified the option 'Tick to certify maintenance for migrant (and dependants, if applicable):' as 'Y'.
Now I'm applying for dependant visa for my hubby and son.
Should I show maintenance proof.I was thinking it's not required, but in one website I saw the below lines and got confused,if the maintenance certified is only for first month of my employment which is already over.

If a sponsor certifies maintenance for any dependents they are confirming that they will maintain and
accommodate each dependent (to a level of £600 or more) up to the end of their first month of the
main applicant's employment in the UK, if required.

Please can someone clarify?

Thanks.

if your dependents didnt apply with u, then they will either need a bank statement to prove it or a letter from your employer to certify that they will maintain your dependents for 1 month
