Query on Tier 2 General & ILR Long Stay Eligibility

Post by Kokkadan » Thu Aug 24, 2017 2:12 pm

Dear Friends,
I came to the UK as a student in March 2010 and got my PSW and switched to Tier 2 General in 2013 and with my further extension with the same employer which will be expiring in 2019 and to complete 10 years short with 6 months. Whats the best way to hold on for this 6 months in the UK legitimately in order to apply for ILR through Long Resident route. Could someone through insight on this situation please.

Thanks
Varkey

ILR based on Long Residence Eligibility - Short to complete 10 Years

Post by Kokkadan » Fri Aug 25, 2017 1:08 pm

Hi Moderators,
What all are the options to apply for ILR based on Long Stay when it is shorter with 6 months to complete 10 years long residency. I came to UK as student in 2010 and switched to Tier 2 General in 2013 and extended last 2016 and my visa expires in 2019 before 6 months to complete my 10 years in UK. Any insight on this situation will be very much helpful.

Kind Regards

Hi Makky,
It's mainly with the Salary, my employer won't be able to offer me required £35.8 at that point, currently, I am on £26k and the maximum they could offer me is £28k which I don't blame them for.

Kind Regards

Hi CR001,
Would you be able to throw some insight on how to legally apply for ILR based on Long Residence when I will be 6 months short on my 10 years long residence eligibility? I got my wife with me as my dependent who joined me in 2015 and a son who was born here in 2016. Currently on extended Tier 2 General which expires in September 2019.

Kind Regards
Varkey

Personally I think the only legal option for you would be to switch to Tier4. I don't see any other options.

You also need to remember that if you apply for ILR based on long residence, your dependents will have to switch to FLR(M) and meet all those requirements (English A2 and financial requirement) and this will reset their clock to zero and a new 5 year route (2 x 2.5 year visas) before they qualify for ILR. The time spent on PBS dependent will be lost and cannot be counted towards the new 5 year residence period on FLR(M).

UK born child can be registered as British once you get ILR.
