Birth Certificate not available for Spouse visa via Family Route

Post by abhishek7749 » Tue Sep 26, 2017 4:46 pm

Hi,

While filling up the Family Route Visa Extension for my Spouse online, we were asked to submit the Birth Certificates of the myself and my Wife. This was added in the document list after we indicated that we have 2 children who are British citizens and are not applying for Visa.
I am on ILR and my wife is a on PBS dependent visa set to expire on 21 Oct.
We do not have enough time to get the Birth Certificates.
Should we submit the application without the Birth Certificates?
Can our passports be provided as an evidence instead of Birth Certificates?

Thanks,
A

I don't think your birth certs are required.

Are you sure it is not asking for the Children's birth certificates, this would make more sense??

On what basis did you get ILR, 5 years PBS or 10 years long residence?

I got ILR based on 5 year PBS.

The Document lists the following documents.

Birth certificate of both of Mr ********** parents
Birth certificate of both of Mr ********** parents

*Names of children have been hidden.

These are in addition to the birth certificates of children.

Why are you apply for a family route spouse visa and not extending the PBS dependent visas??

Which application form exactly are you completing?

As I have now got the ILR so the visa has to be extended via Family route.
Last time at the immigration counter at Heathrow, we were asked to get the Family route Spouse visa since I am no longer on Tier 1 Visa.

I am applying online at this link

They can stay on PBS dependent visa until they qualify for ILR if you got ILR based on 5 years residence. The immigration rules allow this. The IO at Heathrow was wrong. See dependants-of-ilr-economic-5-year-route-applicants (click)

It is only if you got ILR on 10 years long residence that they must switch visas to family spouse visa.

If you apply to change their visas now, it will reset their clocks to zero and a new 5 year route (2 x 2.5 year visas) before they can apply for ILR.

Bank Statement for Spouse Visa

Post by abhishek7749 » Wed Oct 04, 2017 6:09 pm

Hi All,

I am applying for the PBS dependent Visa.
It is required to submit official Bank Statement to prove financial requirements.
I went to the branch office of bank and they gave me a transaction list of all the transaction for the past 6 months. This transaction list is on the bank's official stationery (letter head).

Will this transaction list be acceptable to the UKVI?

Kind Regards,

Yes as long as the bank letterhead is original coloured and demonstrating the necessary details apart of transactions like accounts number, sort code, accounts type, account holder name & address etc.
The opinion expressed as above is neither a professional advice nor contesting/competing to other member's opinion/advice.

There is no financial requirement for a PBS Dependent visa. You only have to meet the maintenance requirement.
