Tier 2 -> EEA Switch for contracting

Post by erevin22 » Wed Oct 18, 2017 6:59 pm

HI,

I am an non EU with a tier 2 visa. My wife is from EU and she has recently applied for a Registration Certificate online. As part of the registration certificate, she has added be as her dependent which means I will give away my tier 2 visa. The process takes 6 months, but I have already got a contracting offer which I would like to undertake with a limited company.

Would I be able to quit my job and take up the contracting job even before I get the UK resident card, or am I playing with fire and better wait?

Thank you

Does that mean you are getting a residence card as a family member of an EEA citizen?

I have at the moment both RC and Tier 2 visa. I will be working under my Tier2 visa until my contract finishes and then stay in the UK with my RC and get another job. When you receive you RC you don't have to give away your Tier 2, as they are ruled by different regulations.

When you apply for your RC, you will get a CoA with right to work if you are married and then you will be able to take the contract job. However, i am not sure how long the curtailment of your Tier2 can take.

Thanks Lunallena!

Yes, I am looking to get RC as a family member of EEA national. In fact, my wife applied for EEA(QP) online and included me as dependent.
I am currently holding a General Tier 2 visa, because my company sponsored my visa and I came to UK first and my wife, who was my GF as that time followed me later.
I understand that the General Tier 2 visa is tied to my company who sponsored it, but since the contract job I got is pretty decent and I am keen to take it up, the only problem is that I am told to wait until RC is issued to me before I can take the contract job. Is there a way I can get the RC faster, even paid service? Waiting for 6 months until RC is issued is 6 months loss in in earnings

Thanks

As far as I know, there is no premium or priority service for RC under EEA regulations. I think the HO has improved its processing times, with some people getting the RC in three months.

Hello,

Apologies in advance if the question has been asked. Here it goes. My wife is from EU and I am from a non EU country. She is an IT professional in UK working since Aug 2016 and currently exercising her EU right. I am also an IT professional in UK since Aug 2015. I have a tier 2 visa sponsored by my company. I would like to give up my current visa and exercise my right as EU family member so that I can work as a contractor.
Given the new changes with regards to Brexit, what is my best option please? Advices are welcomed.

Thank you

Kindly refrain from multiple topics/posts (click) and keep ALL your questions in ONE thread (ie this one) where you have already received advice.

Also please desist from posting your EEA FM questions in the referendum-news-and-developments sub forum (click) as this is not the correct sub forum for EEA FM questions.
