Hello,
I applied for a fee waiver for my FLR FP and was rejected because they said
1. I have not demonstrated that I would be destitute if I paid the fee
2. I don't have exceptional circumstance
I have been in the UK for 13 years and have a kid who is 9, both parents are not British and I dont know my ex-wifes status, last time i knew she had a TIER 1 work permit.
I havent worked in all my years in the UK due to one immigration problem after the other, so now i applied outside the rules for the 10 year route. I am a MSc holder in the UK
MY INCOME
I get £600 from my family (outside the UK) of which half goes to my daughter and the other half I struggle with. I am very deep in debt (£20,000) and provided a CFS d(Common Financial Statement) from money advise and proof that my I am in rent arrears for 9 months from my landlord who is supporting me in my application. I also submitted details of every penny i receive and spent over the last 6months bank statment
MY FEE WAIVER ARGUEMENTS
I submitted both that I would be rendered destitute and exceptional circumstances, which were both rejected, as they said i havent shown evidence of exception circumstances.
I have been rejected 3 times now, and resubmitting for the 4th.
What on earth do they want me to show ? They said I should borrow from my family or pay the fee over 12 months. I setup a business and was asked to close it down. I dont have any means of borrowing as I am steeped deep in debt
thanks
Bay

Unfortunately that's the way they treat now.
You have only 2 options
1: pay the fee
2: instead of re applying again find a legal aid solicitor and file a judicial review i am positive you will then be considered.
I recommend 2nd option because I don't think re applying will help because it's not the merit of the case but targets.

thanks for your reply
I realized that the HO are playing games.
1. They hid my bank statements and were not returned
2. They ignored the letter from my landlord which stated I was in rent arrears
3. The detailed arguments I presented quoting the UK laws and explaining my finances along with a breakdown of my last 6 months bank statements too were not returned
... and the rejection letter, claims they never received any of them
I spoke to my local MP, who said I should make a fresh application and she would send the pertinent documents and make a formal complaint to the immigraiton minister
if this is rejected again, I would get the ombudsman involved and then do a JR, by then 2018 my daughter would be 10 and get her UK passport

Hi just giving update to people on similar situation who applied for a fee waiver. I had applied for it in June 2017 and received recognition that they have received the application with in a week. Then until jan 2018 received nothing I was worried why HO haven’t sent the biometric enrolment letter. In jan 2018 I received the letter that my application for fee waiver has been accepted and I need to enroll my biometrics.

Dear vbay, I think you misunderstood the whole thing. First of all you have no choice other than to pay the fee making another application will be waste of time and judicial review is out of question because it will cost you money and end result will be same. You said you are in the country for last 13 years and without a job so how did you survived providing supporting documents from your family and landlord goes against you as the purpose of this application is to save you to be destitute, even you have 9 months of rent arrears but you still got roof and plus landlord letting you live and providing you documents and when your family can provide you £600 they can provide more so that’s why HO offered you part payments. If I was you I would not make any application as only 1 year left for your child to be registered as British National once you done that put your application in and obviously you have to pay for it unfortunately there is no way around for you

Hi guys, i think you got the whole things wrong HO are clever looking for your simple mistake in which you fallen into it and they make used of it against you .. only options now is just wait for your child to turn 10 years old and put in application as parent of British child get better position getting your visa granted base on that route ...

Yes but that is not free either, I would still have to pay for the fee or apply for the waiver.
My daughter is 10 this november
