Question on Tier 2 general - After cooling off period

hello

i had a tier 2 general visa till 30/10/2016

i have now a job that requires a tier 2 visa and have a COS (issued 15/8/17)

i am outside the uk (mauritius)

just read the small print on the rules, and seen this cooling off period

can i apply for my visa now? or will the application simply be rejected when submitted?

or do i have to wait till 30/10/2017?

On what date did you leave the UK in 2016??

Personally what I would do in your situation:

1)Get employer to put an employer note in CoS to change start date change to Nov 1, 2017. Use this date in your Tier 2 application as well.

2)In the the additional comments section of your tier 2 app. Explicitly note the dates of your cooling off period.. eg.. October 26,2016-October26,2017 and that this is no longer in effect as of your job start date. (if you have a stamp that proves entrance to another country reference the pg)

3) I would also say entrance into country of October 27 or later (just to be safe) on your application.

I personally am starting a new job 2 years after since I last worked in the UK and made a similar note of when I exited UK - Make it easy for the entrance clearance officer to do their job.

Think this should be fine with your existing COS as within 3 months of the initial allocation and you can still apply as soon as the update is made in number 1.

So i lived in the uk on a tier 2 for many years and left in Oct 2016 and applying to come back

When i was in the uk, i travelled abroad a lot to Europe for holidays

Does a 'visit' as specified in the question qualify as me coming back into the country to work for a few months and leaving again for a holiday?
