Hello,
My wife is on an employee sponsored Tier 2 visa, I joined her in the United Kingdom half way through her stay here, that is 1 year 6 months. We need to do a visa renewal later this year, but if we do a 3-year renewal then it means that after 3 years, I will have stayed in the UK for 4 years 6 months which is just 6 months shy of the 5 years required to apply for an ILR.
My questions are as follows:
1. Can we apply for a 5 year renewal ?, will the Home Office approve this for her since it will be a total of 8 years on a Tier 2 employer sponsored visa and if they can approve this then will she be able to apply for an ILR 2 years before the expiration of a 5-year Tier 2 visa.
2. If we apply for a 5 year renewal, can the home office grant me a 5-year extension and then grant her a 3-year extension or is it the case that because I am a dependent then it has to be the same?
3. If the Home Office will not grant a 5-year extension, then at the end of the 3-year extension, I would have been here for a total of 4 year 6 months, do I have to apply for another Tier-2 dependent visa since my wife will be applying for an ILR at the time?...Wouldn't that be double spend since I will be able to apply for an ILR in just 6 months and since she is applying for an ILR will I be able to apply for a Tier 2 dependent visa without issues?
4. If my wife gets her ILR, will it be advisable to apply for an ILR dependent visa since I will just have been here for only 4 year 6 months?, will that reset the clock for another 5 years or something if I do.
5. What is the best way to apply for a Tier 2 dependent visa extension if my wife switches to an ILR? Is this a straightforward process?
