Overstayed for a month

Post by Annie123 » Tue Jan 23, 2018 5:10 pm

Hope you can help.

I came this country on spouse visa. My visa expired on the 30th September 2017. My visa was to be renewed but due to family emergency my husband, mother in law and father in law had to fly out of the country.

Also, I completely forgot to renew my stay.

Now, my application been rejected- why I delayed my application. 1 month late.

We have appealed and given that my husband was not in the country and we forgot. Will that excuse be ok?

We have been married 4 years and have no children. I work and study a diploma course.

Please advise, what I can do or what can happen.

Not really a good enough 'excuse' or reason.

You have posted in the ILR sub forum but state visa renewal. Can you confirm exactly what you have applied for ILR on Set(M) or spouse visa extension on FLR(M)?

If visa has been overstayed more than 28 days then its difficult to challenge.
The opinion expressed as above is neither a professional advice nor contesting/competing to other member's opinion/advice.
