Clarify on cap for ILR

Post by krishpa » Tue Feb 06, 2018 4:09 am

Hi,

When I was on Tier 4, the college was revoked and did not get my curtailment letter nearly for 8 months, moreover, I applied for Tier 2 G which was granted.

Will this be affected my ILR on 10 years route?

Could please Gurus clarify on this?

Regards,

KP

If your leave wasn’t curtailed and you applied in-time for Tier 2, then you should be okay.

Amen! brilliant. I was little worried whether that be considered as overstayed even though I had my Tier2 General.

So you sure that still, I can apply my ILR on 10 years route now?

Thanks, Vinny!

Hi Vinny,
sorry, could you please clarify on this, what you meant by "applied in time" when I did not get my curtailment letter for 8 months. I applied before to get the Curtailment letter from HO. (but I was in luck I think).

By in-time, I meant that you applied before your leave had expired or curtailed, if applicable.

Also asumming that you didn't break any conditions that they gave you notice of, e.g. Working over the limits, etc.

Don't believe everything you 'hear' from a 'mate' at the pub, on the bus, in the supermarket etc.
