Tier 4 dependant fot wife in 2018

Post by roxinthebox » Tue Jan 23, 2018 6:40 am

Good morning, dear Sir!
I have difficult situation with my husband Kirill (he is Tier4 Student and sponcored by Russian Goverment, he is a PhD physics student in RHUL). He studing in UK 1 year already (since February 2017), but we married just now, in January, 2018. When he started his study in UK, I can't join him because I studied in Russia and wasn't his wife (but our relarionships started in 2013 and in 2014 we started live together and when he made his Tier4 Student visa, he mentiond me as fiancee and I live in his flat since 2014 till now). So in this year in May I'll finish my study and in July want to join Kirill. But all documents for visa we can collect just now, because he unlikely will come to Russia in summer. So Fabruary is the only way for us.
In this situation I have some questions:

Can I aply for a Tier4 dependant visa without main aplicant (my husband)? He already have his visa within 1 year and it was a long time when he lived there alone, but we trying get together as often as we can, but anyway it's hard live separate. Also, in January Guidence for dependants was updated. In chapter 50 (iv) c is a line in which it says:
c) the Tier 4 (General) applicant Migrant and you (the family member) must be applying at the same time.

Must I give with my application any proof of our relationship before marriage or marriage certificate will be enough?

Should we show appartment in which we will live? He rent single flat now and we decided to rent doble flat in case if I get the Visa.

If you have any advise, please, help me, it's really important for us!

I look forward to your reply.
Thank you very much!

Yes.

Paragraph 50 covers a number of different alternate scenarios (i) - (iv), separated by "or". You meet part (i), so I am not clear why you think you need to also meet part (iii).

If you have been living separately, yes. The ECO needs to be satisfied that the marriage is genuine and subsisting, which they may question if you have not been living together.

Thank you very much for your reply!

Please, help me with some quastions once more:
1. Is there need for showing from which source my money came? It's 7605£ and I am just a student. Must I show my scholarship? Must I say that I am a student?
The reason why I didn't apply year ago with my boyfriend - I studied. In this year I'll graduate, but it will be only in July. But we live in Russia, he can take confirmation from his bank account only now, because in Fabruary he'll go back in UK for study. We decided that I go in May for a 1-2 weeks (students have free time in the month because of hollydays), take my BRP, register in police than I go back for a month to finish my study. But how can I explain all this to visa officer? He'll refuse my application in this case...
2. Must my husband show where he lives now? Tangency agreement or something? Should we show where we would live if I get this visa?

Thank you!

Given your ongoing and detailed questions about your application, I advise you and your husband get advice from the international student adviser at his university.

All universities have international student advisers who provide free professional immigration advice to their sponsored students and their dependants. Again,I suggest your husband consults the adviser at his university.

He asked already and adviser said that he don't need a new CAS. I have visa advisors in Russia and they said that he need the new CAS. I think that his advisor is just lazy (husband wrote directly to man who provide CASes) and don't want doing his own job :|
So I want your opinion, please, help !

It blows my mind. You want to disregard the advice of a professional student immigration adviser whose job is to make sure that a university's sponsored students and their dependants make successful UK immigration applications, and instead you prefer to get advice from random strangers online.

Post by roxinthebox » Wed Feb 28, 2018 3:00 pm

We are married and my husband 1 year already studing in UK.
I explore a lot of forums and guidens of course, and this is what I understand about documents I must provide from my husband side:
  • CAS
  • BRP
  • Police registration certificate
  • Passport with Tier4 visa
  • Lease contract
  • Bank statement
  • Cover letter
  • NHS
  • Documents about his scholarship (he has financial support from Russian goverment)
But I'm not sure that it is a full list of documents.
Pleace, if you have some advise, help me.

Where are you getting that list from? I would say you do not need any of those documents, except perhaps the bank statements, but they can be your own statements not his. And you only need bank statements at all if your husband's government scholarship doesn't include money for you, or if it does include you but there is a shortfall between the scholarship and the PBS dependant maintenance requirement.

I think you are getting bad information from somewhere. Maybe the international student adviser at your husband's university can advise on the application?

Bank statement for Tier 4 Dependant

Post by roxinthebox » Tue Mar 20, 2018 2:55 am

Hello, I want to apply asap for Tier4 Dependant, I have enough money to support myself and my husband had enough money to support us both, and I'll attach 2 statements from both of us.
But the problem is that 2 weeks ago I put 700 pounds on my account (a wedding gift from my father for me and husband). I had enough money before this deposit, it was 8700 pounds already (as a debentant I need 7605 pounds), but I thought the more the better, and I'm very sorry now that I did it.
Can you please tell me if there could be problems with this? Or should I wait and make a new bank statement after 2 weeks?
But I'm afraid that Russia and England will get even more heated, so I should do everysing asap.
Please help!
