ILR 10 years and partner's PBS visa expires same day

I am currently on Tier 4 General Student Visa which expires on 05/09/2018.

I came into the United Kingdom on 03/10/2018 but my visa was granted on 22/09/2008. I have had continuous stay in the UK since then, though I have had to go back to my home country twice to renew my visa as but I have not stayed more than one six weeks at any given time and have not spent up to 200 days in total outside the UK in the last 10 years.

I intend to apply for indefinite leave to remain, LONG RESIDENCE, 10 YEAR ROUTE just before my current visa expires, say premium on the 5th of September to avoid it being more than 28 days as stipulated in the immigration rule. .. but my husband is a dependant on my tier 4 visa which expires on the same day as mine, 05/09/18.


My Query please??

?? Can the two of us apply on the same day (premium) to avoid either of us overstaying.

?? Can he apply using FLR (M) or FLR (FP) then vary once I get mine?

could someone please kindly advice?

If your dependent husband has also completed 10 years then you both can apply ILR long residence via two different applications/premium appointments. But if your husband has not completed his 10 years then I think better you go on in person appointment while your husband apply FLRM by post then vary into long residence application once complete his 10 years.

Thank you Seagul but I read on this forum that if he applies with FLR (M) when I have not yet gotten my ILR, it will be refused and counted as invalid with loss of appeal rights.

Could you/anyone else kindly clarify this please

You can both apply on the same day in person, two separate appointments, your spouse after yours. If your ILR fails or is held, the FLR(M) will also fail or be held.
