MARRIAGE TO PARTNER HOLDING TIER 2 (ICT) VISA

Hi All,

Not sure if this has been discussed recently.

My partner is currently a Tier 2 (ICT) holder. The visa expires in 2021.

We would like to get married and I am a little confused regarding the procedure.

1) Does she need any other sort of visa such as a marriage visa to "give notice of marriage" to the local council. Or is the visa she is currently on ok for us to get married on.

2) Once we have successfully managed to get married, will she need to change to a "family of settled person" visa?

1. To marry he don't need any further visa since he has been holding the valid tier 2 visa.

2. On marrying he can change his visa into spouse visa if he wishes otherwise may wish to continue to live at tier 2 visa. Only difference with spouse visa is that he won't be chained up with one employer.

What would the procedure be to get married in the UK as she is a visa holder?

Is it just giving notice to the local council and then proceeding with the civil ceremony?

I've heard that the local council will refer the application to get married to the Home office if it is a foreign national?

If so I need to provide any evidence?

You both have to attend an appointment at an HO approved Registry office to give 28 days notice. Passports and visas must be taken with.

I've heard that the local council will refer the application to get married to the Home office if it is a foreign national?

Yes, they do and HO might extend the 28 days notice to 70 days to possibly investigate and/or interview each of you separately before granting permission to marry.

If so I need to provide any evidence?

For the Registry office, passports and proof of visass.

To confirm, we currently live in two different council areas. In this case do we give notice seperately at our respective councils or together at one local council registry office.
