CoS shortage Occupation

HI,

My company is applying Tier 2 G visa under shortage occupancy. But i wonder they are having 250+ employees and how can they apply in SHortage occupancy catergory?

Is tehre a way to check the employee count of the company?
Please help

Posting here as the topics are relevant to me and not spaming by opening a new one.

I am also switching from Tier 2 ICT dependent to Tier 2 general. Below are my queries

1. My employer is applying my Tier 2 General through Shortage Occupancy under SOC 2136. As this comes under digital category, I saw employee count should be below 250. So is ther any forum to check the employee count of the company?

2. As the VISA is applied under SOC, what is the probabiltiy of getting picked?

3. I saw referal letter in the list of document. Can i know is there any default format for the referal letter?

Kindly help me with answers if anyone knows. Thanks in Advance to you all

There is no way as far as a I am aware that you, the applicant, can check and get information about how many employees your sponsor has. You would need to speak to them.

Also note, that SOC 2136 is a non shortage code on Appendix J and a shortage cord on Appendix K, so not all jobs qualify to be shortage occupation.

Only a 'qualifying company', as detailed below, can use 2136 as a shortage occupation and they need to meet the requirements as listed.
2136 Programmers and software development professionals

Only the following jobs in this occupation code:

Senior developer employed by a qualifying company, where the job requires a person with a minimum of five years’ relevant experience and demonstrable experience of having led a team.

The following jobs in visual effects and 2D/3D computer animation for the film, television or video games sectors:

software developer
shader writer
games designer
The following jobs in the electronics system industry:
driver developer
embedded communications engineer

Thats the only Software dev related occupation listed, I think.
to add on...In this Appendix “qualifying company” means a company which:
(a) has obtained permission from the Home Office to issue a Certificate of Sponsorship in respect of the relevant job on the basis that the job is included on the Shortage Occupation List and the company:
(i) is licensed as a sponsor for the purposes of Tier 2 of the Points Based System,
(ii) at the time of obtaining such permission, employs between 20 and 250 employees (inclusive), or employs fewer than 20 employees and has provided a letter from the Department for International Trade, confirming that the Department has been working with the company and supports the application in relation to its trade or investment activity,
(iii) is not more than 25% owned by a company which has one or more other establishments in the UK and one of those establishments employs more than 250 employees; and
(iv) has not been established in the UK for the purpose of supplying services exclusively to a single company or company group in the UK; and
(b) will have no more than ten Tier 2 (General) Migrants working for it at any one time in jobs to which the requirement to be employed by a qualified company applies, if all Certificates of Sponsorship in respect of such jobs lead to a grant of leave as a Tier 2 (General) Migrant.

Picked i mean here is probability of getting selected

Not sure what you mean by this either.
I saw employee referal letter in the list of documents. i just want to know is this reference about my previous employment or current?

clarification of SOC and skill level requesting:
o references to confirm the migrant’s experience
o job descriptions (to compare to the codes of practice)
o any additional information required to validate the application

It would be required IF your company is a qualifying company AND you as the applicant meet the above requirement and would likely be required from previous employers.

The important questions is whether your company is a qualifying company and what your exact job description and role would be.

In Appendix J, SOC 2136 is in RQF 6.
SOC 2136 is also in Appendix K.

So is it eligible for Shortage occupany RCos.? can you clarify please

Thanks this helps. But still i have a doubt whether my company has more than 250 employees. so will clarify this with them.

Your sponsor needs to meet all the qualifying criteria as far as I am aware. The points do not state "OR".

You need to clarify what your job title etc is.

I have already stated that 2136 appears in both non shortage and shortage. Your employer cannot choose the route, it is wholly dependent on if shortage one meets the restrictive requirements.

Appendix J is non shortage occupation and therefore requires RLMT and you need to meet the points requirement for the sponsor to successfully get a RCoS. Jobs in this SOC 2136 are more general and broad than in Appendix K.

Appendix K shortage occupation is very limited to the following jobs in the specified industry.
